HomeMy WebLinkAboutOrd.5472.11-15-2021 BILL NO. 21-174 ORDINANCE NO. .5Y7f2 AN ORDINANCE APPROVING A PETITION FOR THE CREATION OF A COMMUNITY IMPROVEMENT DISTRICT; ESTABLISHING BLOOMFIELD CROSSING COMMUNITY IMPROVEMENT DISTRICT AS A POLITICAL SUBDIVISION OF THE STATE OF MISSOURI; AND DIRECTING THE CITY CLERK TO NOTIFY THE MISSOURI DEPARTMENT OF ECONOMIC DEVELOPMENT OF THE CREATION OF THE DISTRICT. WHEREAS, Sections 67.1401 to 67.1571 of the Revised Statutes of Missouri (the "CID Act") authorize the governing body of any municipality, upon a proper petition requesting the formation and after a public hearing,to adopt an ordinance establishing a community improvement district; and WHEREAS, on October 8, 2021, a "Petition Authorizing the Formation of a Community Improvement District," a copy of which is attached as Exhibit A hereto (the "CID Petition"), was submitted to the City requesting the formation of the Bloomfield Crossing Community Improvement District(the "District") on approximately 3.15 acres located on the northeast corner of the intersection of South Kingshighway and Bloomfield Road in the City; and WHEREAS, the City Clerk verified that the petition complied with the CID Act; and WHEREAS, the City Council held a duly-noticed public hearing on November 1, 2021, at which all persons interested in the formation of the District were allowed an opportunity to speak and at which time the City Council heard all protests and received all endorsements; and WHEREAS, the City Council finds that notice of the formation of the District has been duly given and the public hearing thereon has been held in which all reasonable protests, objections and endorsements have been heard, all in accordance with Section 67.1431 of the CID Act; and WHEREAS, the City Council further finds that the petition to form the District is proper in that it meets all of the requirements of Section 67.1421 of the CID Act. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,MISSOURI,AS FOLLOWS: Section 1. The Bloomfield Crossing Community Improvement District is hereby created within the City as a political subdivision of the State of Missouri having the powers and purposes set forth in the CID Petition. The District shall include the contiguous tracts of real estate described in Exhibit A of the CID Petition, and shall be governed by a board of directors consisting of five (5) members hereafter appointed by the Mayor with the consent of the City Council in accordance with the CID Act, subject to the qualifications set forth in the CID Petition. The District is authorized to impose a sales tax in the amount set forth in the CID Petition. Section 2. The term of the existence of the District shall be from the effective date of this Ordinance until 27 years from such effective date. Section 3. The City Council hereby finds and determines that the real property located in the District is a"blighted area"pursuant to Section 67.1401.2(3) of the CID Act. Section 4. The City Clerk is hereby directed to prepare and file with the Missouri Department of Economic Development the report specified in Section 67.1421.6 of the CID Act. Section 5. The officers of the City are hereby authorized and directed to execute all documents and take such actions as they may deem necessary or advisable to carry out and perform the purposes of this Ordinance and to make ministerial alterations, changes or additions to the documents herein approved, authorized and confirmed which they may approve, and the execution of such action shall be conclusive evidence of such necessity or advisability. All actions taken to date by the officers of the City with respect to the CID Petition and the District, including, without limitation, the provision of notices for the public hearing regarding the creation of the District, are hereby ratified. Section 6. It is hereby declared to be the intention of the City Council that each and every part, section and subsection of this Ordinance shall be separate and severable from each and every other part, section and subsection hereof and that the City Council intends to adopt each said part, section and subsection separately and independently of any other part, section and subsection. In the event that any part, section or subsection of this Ordinance shall be determined to be or to have been unlawful or unconstitutional, the remaining parts, sections and subsections shall be and remain in full force and effect, unless the court making such finding shall determine that the valid portions standing alone are incomplete and are incapable of being executed in accord with the legislative intent. Section 7. This Ordinance shall take effect and be in full force 10 days after its passage by the City Council. The undersigned, being (1) the owners collectively owning more than fifty percent by assessed value of the real property within the boundaries of the hereinafter -described community improvement district and (2) more than fifty percent per capita of all owners of real property within the boundaries of the hereinafter -described community improvement district, do hereby petition and request that the City of Cape Girardeau, Missouri (the "City"), create a community improvement district as described herein under the authority of Sections 67.1401 to 67.1571, inclusive, of the Revised Statutes of Missouri (the "Act'). B. The name of the proposed district shall be the `Bloomfield Crossing Community Improvement District." C. The purpose of the proposed district is to identify, prioritize and fund services and improvements as determined by the board of directors, which will consist of five directors appointed by the Mayor with the consent of the City Council. Each director shall be either an owner of real property within the proposed district or a legally authorized representative thereof. At all times, at least one director shall meet the requirements of Section 67.1451.2(3) of the Act. G. The total assessed value of all real property in the proposed district is $374,500. H. A community improvement district ("CID") is a vehicle established under Sections 67.1401 to 67.1571 of the Revised Statutes of Missouri (the "Act"). CID's are empowered and created to provide a variety of services and to finance a number of different services and improvements. CID's derive their revenue from taxes and 'assessments levied only within the boundaries of the CID. As revenues from the CID sales tax and other sources permit, the proposed district intends to fund or assist in funding the proposed services and improvements described below. B. The Proposed Services and Improvements. The proposed district will fund or assist in funding the CID services and improvements described below, as well as the administrative, legal and other costs relating to the ongoing operation of the district. The proposed services and improvements (collectively, the "CID Project") include the following: • Rehabilitation and renovation of commercial buildings • Demolition of commercial building • Parking lot and internal vehicular and pedestrian traffic improvements C. Estimated Costs. The estimated cost of the CID Project is $1,300,000. Administrative, legal and other costs associated with the ongoing operation of the proposed district are not expected to exceed $12,000 per year. D. Anticipated Sources of Funds to Pay Costs. The district expects to pay these costs with either (1) the proceeds of bonds, notes or other obligations secured by district sales tax and special assessment revenues or (2) directly from district sales tax and special assessment revenues as they are generated. E. Anticipated Term of Sources of Funds. The term of these sources is anticipated to be coterminous with the existence of the District. F. Schedule of Activities. Kingshighway 1. INTRODUCTION This Blight Analysis addresses property conditions at 330, 360, 364 and 372 S. Kingshighway (the "Study Area'). The Study Area includes two parcels (Parcel Nos. 20-312- 00-04-005.01-0000 and 20-312-00-04-005.00-0000) containing a total of approximately 3.15 acres. The parcels are located on the northeast corner of the intersection of S. Kingshighway and Bloomfield Road in the City of Cape Girardeau (the "City "), Cape Girardeau County (the "County"), Missouri. A map and aerial photo of the Study Area are attached as Exhibit 1A and Exhibit 113, respectively. The property is owned by J. S. Coalter & Associates, Inc The Southeast Missouri Regional Planning and Economic Development Commission (the "SEMORPC") was retained to conduct an analysis and determine whether the Study Area satisfies the qualification criteria as a "blighted area" under the Community Improvement District Act, Sections 67.1401 to 67.1571 of the Revised Statutes of Missouri (the "CID Act"). This report covers events and conditions existing on the date of our site visits on September 14, 28, and 30. Events, conditions, and actions occurring after these dates are excluded from this analysis. In addition to the site visits, the evaluation of the Study Area was supplemented with information provided by staff from the Cape Girardeau Public Works, the office of the Cape Girardeau County Assessor, and others. Certain redevelopment incentives, such as community improvement district revenues to renovate, reconstruct and rehabilitate privately -owned properties, are available in areas that the City determines to be a "blighted area" under the CID Act. The owner of the property in the Study Area has requested that the City find that the Study Area is a "blighted area" under the CID Act and make the redevelopment incentive available to assist in the redevelopment of the Study Area. Section 67.1401.2(3) of the CID Act, defines a "blighted area" as having the same meaning as defined in Section 99.805 of the Revised Statutes of Missouri. This definition defines a "blighted area" as: ... an area which, by reason of the predominance of insanitary or unsafe conditions, deterioration of site improvements, or the existence of conditions which endanger life or property by fire and other causes, or any combination of such factors, retards the provision of housing accommodations or constitutes an economic or social liability or a menace to the public health, safety, or welfare in its present condition and use (Section 99.805(1), RSMo.) This analysis will detail the reasons why the existing conditions within the Study Area support a determination that the Study Area is a "blighted area." H. EXISTING LAND USE The Study Area is located on the northeast corner of the intersection of South Kingshighway and Bloomfield Road. The sole use of the property in the Study Area is commercial. The property contains two buildings. The total square footage of all buildings is 42,201, excluding canopies and awnings. The smaller of the two buildings has a 980 square foot permanent canopy. The Study Area also includes 93,820 square feet of asphalt paving. The larger of the two buildings was constructed in 1964 and was made of wood framing and cinder block. The smaller building was constructed in 2003 of wood framing with a metal canopy Surrounding land uses around the Study Area are commercial. The study area is zoned M- 1, Light Manufacturing/Industrial. III. FINDINGS It is the opinion of the SEMORPC that the Study Area meets the definition of a blighted area under the CID Act. The SEMORPC arrived at this opinion based upon the following factors: A. INSANITARY OR UNSAFE CONDITIONS Insanitary or unsafe conditions are conditions present on a property that create a menace to the public, health, safety, morals, or welfare. Water damage: The exterior of the larger building has separated from the sidewalk allowing for water infiltration. The cinderblock wall shows signs of water damage. Exterior doors are rusted, and the sidewalk and parking lot are cracked and crumbling. Pockets of standing water can be found around structures indicating improper drainage away from buildings. The roofs show visible signs of water damage both in the interior and exterior. Age: As noted above, the larger building in the Study Area was built in 1964. Although the SEMORPC did not specifically test the Study Area for the presence of asbestos and lead paint, it notes that (1) buildings built before 1980 are more likely to contain asbestos (primarily in resilient floor tiles, ceiling tiles and roofing materials) and (2) buildings built before 1978 are more likely to contain lead paint. Conclusion: Water damage to buildings can create mold or indicate structural damage that could harm visitors to those buildings. Older buildings may have asbestos and lead paint that present public health issues if not properly remediated. B. DETERIORATION OF SITE IMPROVEMENTS: Deterioration of site improvements includes physical deficiencies or disrepair in buildings or site improvements requiring treatment or repair. Physical Deterioration: The improvements within the Study Area are in a state of deterioration. The following conditions were observed: • Paint is bubbling and peeling in multiple locations. • Sidewalks are uneven, cracked and crumbling. • All store fronts are not ADA accessible due to parking layout. • Electrical to the complex sign is exposed and accessible to the public. • Sidewalks are cracked, crumbling and present a tripping hazard. • Interior floor is uneven due to water damage. • Exterior walls exhibit water damage. • Roof exhibits presence of water damage. • Bay access lighting can be remotely extinguished while people are present. • Utility poles limit access to loading bays. • Rust and stained ceiling show water infiltration. • Property entrance from southbound Kingshighway is a pinch point in parking lot and loading area. • Surrounding vegetation holds water presenting vermin and insects a breeding opportunity. • Vacant store fronts are present. Conclusion: The above-described evidence of physical deterioration is significant and in need of treatment or repair. C. ENDANGER LIFE OR PROPERTY BY FIRE OR OTHER CAUSES This eligibility factor is used to determine the potential risk to life or property by fire or other causes. Obsolete and Exposed Electrical: Obsolete/unused electrical connections to power lines were still connected to the larger building structure. Electric to the complex sign was exposed and accessible by the public. Some of the electrical panels appeared to have previously been exposed to water. Thermal images of the roofs appear to indicate water damage. These conditions are evidenced by photos located at the end of this report. Conclusion: The obsolete and exposed electrical utilities present opportunities for tampering or malfunction, which could cause fire, electrocution or otherwise endanger life or property. As a result of the conditions relating to insanitary and unsafe conditions, deterioration of site improvements and the endangerment of life or property by fire and other causes described above, the Study Area is an economic liability and is a menace to the public health, safety, or welfare in its present condition and use. The condition of the buildings in the Study Area, as described above, and the cost of remediating those conditions, are economic liabilities preventing the Study Area from reaching its potential. An economic liability exists because of (1) the cost of remediating the blighted conditions present in the Study Area and (2) higher level of retail sales, assessed values and jobs that could be achieved within the Study Area if it were in better condition. Retail tenants are unlikely to locate or stay in obsolete, outdated and deteriorating buildings. As a result, until the conditions in the Study Area described above are remediated, the Study Area will be expected to generate an inadequate level of taxes compared to similarly situated commercial properties. The present condition of the Study Area also presents a menace to the public health, safety or welfare in its present condition and use as a result of the danger posed by buildings infiltrated with water damage and the obsolete and unused electrical connections. IV. CONCLUSION The blighting analysis and conditions identified in the Study Area meet the principal requirements for a "blighted area' designation, as outlined the CID Act. The Study Area, by reason of insanitary or unsafe conditions, deterioration of site improvements, and the existence of conditions which endanger life or property by fire and other causes, constitutes an economic liability or a menace to the public health, safety, or welfare in its present condition and use. These conditions have acted as a constraint and economic impediment to redevelopment of the site. Significant costs must be incurred to cure the Study Area's deficiencies and blight. Public investment in the form of community improvement district tax revenues can leverage private investment to mitigate the blighted conditions described in this document. The SEMORPC believes that the extraordinary cost to revitalize the Study Area are financially 13 infeasible under current market conditions without the incentives permitted by the CID Act. This makes it improbable that the Study Area will experience growth and development solely through investment by private enterprise unless a community improvement district is created to assist in the redevelopment of the Study Area. It is in the public interest to encourage and assist in the removal of the blight, as allowed under the CID Act.
