PERMANENT SANITARY SEWER EASEMENT
. KNOW ALL PERSONS BY THESE PRESENTS: OFF THE RESERVATION, LLC, a.
Missouri Limited Liability Company, for and in consideration of the sum of One Dollar ($1.00)
and other good and valuable consideration, the receipt whereof is hereby acknowledged, does by
these presents, Grant, Bargain, Sell and Convey to the City of Cape Girardeau, Missouri, a
Municipal Corporation, hereinafter referred to as the "City", the right, privilege, permission, and
authority to enter on and upon the following described property, which is solely owned by the
undersigned and located in the City and County of Cape Girardeau, State of Missouri, to wit:
A STRIP OF LAND 20.00 FEET WIDE, LYING 10.00 FEET ON EACH SIDE
OF THE FOLLOWING DESCRIBED CENTERLINE:
A PART OF UNITED STATES PRIVATE SURVEY NO. 3314, TOWNSHIP 31
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN, CITY
AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI BEING
MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE EAST QUARTER CORNER TO SECTION 22, SAID
POINT BEING ON THE WEST LINE OF USPS 3314; THENCE N 88° 46' 35"
E, 661.70 FEET ALONG THE NORTH LINE OF DOCUMENT NO. 2015-
09209 TO A 1/2" IRON PIN (FOUND); THENCE S 01' 33' 12" E, 103.33 FEET
TO THE POINT OF BEGINNING:
THENCE S 740 43' 31" E, 31.65 FEET; THENCE S 500 48' 15" E, 367.79 FEET;
THENCE S 750 I F42" E, 217.76 FEET TO THE NORTH LINE OF WALDEN
PARK PHASE 3 AS RECORDED IN PLAT BOOK NO. 2013-02032 AND
THERE TERMINATING.
Said right, privilege, permission, and authority to enter on and upon the above described
property is granted for the purpose of enabling the City as well as its agents, servants, and
assigns to use said property to excavate, build, construct, operate, maintain, and repair sanitary
sewer improvements in, on, upon, or across said property, together with all of the useful,
necessary, and proper adjuncts, appurtenances, and appliances in connection therewith. This
easement and the right, privilege, permission, and authority herein granted are perpetual and
shall run with the land.
The undersigned covenants that they are the owner in fee simple of the above described
property and have the legal right to convey the same.
IN WITNESS WHEREOF, the undersigned has executed this easement on this
day of 52021.
