Also a strip of land 20 feet wide lying on the southeast side of and adjacent to
the right of way of Giboney Street more particularly described as follows:
Beginning at a point at the intersection of the Northwest right of way line of
Giboney Street with the east right of way line of Sprigg Street, thence N. 51
36' E. along the east right of way line of Sprig Street 250 feet, thence S. 841
24' E. to the Northwest right of way line of Giboney Street, thence S. 501 46'
E. 50 feet to the southeast right of way line of Giboney Street for the Point of
Beginning, thence continuing S. 501 46' E. for a distance of 20 feet, thence S.
391 14' W. parallel to the southeast right of way of Giboney Street for a
distance of 250 feet, thence N. 501 46' W. for a distance of 20 feet to the
southeast right of way line of Giboney Street, thence N. 39° 14' E. with the
Northwest right of way line of Giboney Street for a distance of 250 feet to the
point of beginning.

ORDINANCE NO.545 -7
AN ORDINANCE VACATING THE CITY'S INTEREST IN
A PORTION OF GIBONEY AVENUE RIGHT-OF-WAY, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, the City desires to pursue vacation of a portion
of Giboney Avenue right-of-way, in the City of Cape Girardeau,
Missouri; and
WHEREAS, a public hearing was held on September 7, 2021, at
which time all interested parties were afforded the opportunity
to speak in favor of or in opposition to the proposed vacation
of this portion of Giboney Avenue right-of-way; and
WHEREAS, at least ten days notice of the time and place of
this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, the City Council has determined that the property
in question is not necessary or needed for any of the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the portion of
Giboney Avenue right-of-way be vacated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council hereby finds that it is in
the public interest that this portion of Giboney Avenue right-
of-way be vacated.
ARTICLE 2. The City's interest in the portion of Giboney
Avenue right-of-way, located in the following described real
estate:
Also a strip of land 20 feet wide lying on the
southeast side of and adjacent to the right of way of
Giboney Street more particularly described as follows:
Beginning at a point at the intersection of the
Northwest right of way line of Giboney Street with the
east right of way line of Sprigg Street, thence N. 5°

Street 250 feet, thence S. 84° 24' E. to the Northwest
right of way line of Giboney Street, thence S. 50° 46'
E. 50 feet to the southeast right of way line of
