AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, REGARDING STORMWATER MANAGEMENT
FACILITIES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Section 25-1107, entitled "Stormwater", of
Article XI of Chapter 25 of the City Code, reading as follows :
Sec. 25-1107 . - Stormwater.
(a) Storm sewers . Storm drainage improvements consisting
of storm sewers or open channels shall be provided for any
development or redevelopment as determined by the city
manager. Such improvements shall adequately drain the area
being developed. The design of such improvements shall be
coordinated to the extent possible with present and
probable future improvements so as to form part of an
integrated system. Adequate provisions shall be made for
the disposal of stormwater, in accordance with the city' s
standard specifications and drawings, and subject to the
inspection and approval of the city manager.

Chapter 25 of the City Code, is hereby enacted in lieu thereof,
in words and figures, to read as follows, to-wit :

the disposal of stormwater, in accordance with the city' s
standard specifications and drawings, and subject to the
inspection and approval of the city manager.
(b) Private stormwater management facilities; maintenance
responsibility. Prior to the issuance of a stormwater
management permit for any project involving a new private
stormwater management facility or an alteration of an
existing facility, the owner of the property upon which
such facility is located shall execute a deed restriction
to ensure the perpetual maintenance of such facility in
accordance with the city code. Such deed restriction shall
contain all necessary information as determined by the city
manager and shall be recorded in the office of the recorder
of deeds for the county in which such property is located.
ARTICLE 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
ARTICLE 3 . It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and the sections of this Code
may be renumbered to accomplish such intention.
ARTICLE 4 . This ordinance shall be in full force and
effect ten days after its passage and approval .
