KNOW ALL PERSONS BY THESE PRESENTS: Midamerica Highway K, LLC a Missouri
Limited Liability Company in consideration of the sum of One Dollar ($1.00) and other good and
valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, bargain, sell and
convey to the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation, hereinafter
referred to as the "City", the right, privilege, permission and authority to enter on and upon the
following described property, located at 4072 State Highway K, which is solely owned by the
undersigned located in the City and County of Cape Girardeau, Missouri, to -wit:
DESCRIPTION - EASEMENT 1
THAT PART OF THE NORTH HALF OF FRACTIONAL SECTION 3, TOWNSHIP 30 NORTH, RANGE 13 EAST OF
THE FIFTH PRINCIPAL MERIDIAN, IN THE COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI, MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT A FOUND SQUARE CUT SANDSTONE AT THE INTERSECTION OF THE NORTH
LINE OF FRACTIONAL SECTION 3 AND THE WEST LINE OF UNITED STATES PRIVATE SURVEY #3090;
THENCE WITH SAID NORTH LINE OF FRACTIONAL SECTION 3, SOUTH 89°42'38" WEST, 803.50 FEET TO A
FOUND SQUARE CUT SANDSTONE ON THE NORTH LINE OF SAID SECTION 3; THENCE CONTINUING WITH
SAID NORTH LINE, SOUTH 89°39'27" WEST, 232.39 FEET, TO THE NORTHEAST CORNER OF THE PARCEL
RECORDED IN DOCUMENT NO. 2019-06136 IN THE LAND RECORDS OF CAPE GIRARDEAU COUNTY
MISSOURI; THENCE LEAVING SAID NORTH LINE AND WITH THE EAST LINE OF SAID PARCEL, SOUTH
00°08'19" EAST, 252.79 FEET; THENCE SOUTH 31°34'09" WEST, 99.29 FEET; THENCE SOUTH 00°2948" EAST,
174.11 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 00°29'48" EAST, 10.00 FEET; THENCE LEAVING
SAID EAST LINE, NORTH 78°54'15" WEST, 10.21 FEET; THENCE NORTH 00°29'48" WEST, 7.95 FEET; THENCE
NORTH 89°30'12" EAST, 10.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 90 SQUARE FEET,
MORE OR LESS.
Said right, privilege, permission and authority to enter in and upon said property above
described is granted for the purpose of enabling the City, its agents, servants, and assigns to use said
property to excavate, build, construct and maintain certain improvements, in, on, upon, or across said
described property, together with all the useful, necessary and proper adjuncts, appurtenances, and
appliances in connection therewith, as shown on the plans and specifications on file in the Office of the
City Engineer. This easement and the right, privilege, permission and authority herein granted are
perpetual and shall run with the land.
The undersigned covenant that it is the owner in fee simple of the above described property and
has the legal right to convey the same.
