AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 2979 BEAVERCREEK DRIVE, IN THE CITY
AND COUNTY OF CAPE GIRARDEAU, MISSOURI, FROM
R-1 TO R-3
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-1, Single-Family Suburban Residential
District, to R-3, High Density Single-Family Residential
District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, December 7, 2020; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 of this ordinance from R-1, Single-Family Suburban
Residential District, to R-3, High Density Single-Family
Residential District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-1, Single-Family Suburban
Residential District, to R-3, High Density Single-Family
Residential District, for the following described property:
2979 Beavercreek Drive
THE EAST PART OF LOT NO. 3 OF MT. AUBURN SUBDIVISION
NO. 9 AS RECORDED IN PLAT BOOK 20 AT PAGE 92 OF THE
LAND RECORDS OF CAPE GIRARDEAU COUNTY, MISSOURI, IN
THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISSOURI, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGIN AT THE NORTHEAST CORNER OF SAID LOT 3, THENCE,
WITH THE EAST LINE OF SAID LOT #3, SOUTH 01°07' 51"
WEST, 197 . 36 FEET TO THE SOUTHEAST CORNER OF SAID LOT
NO. 3, THENCE WITH THE SOUTH LINE OF SAID LOT NO. 3,
NORTH 78°44' 00" WEST, 45 . 44 FEET TO A BEND IN THE
SOUTH LINE OF SAID LOT NO. 3, THENCE CONTINUING ALONG
THE SOUTH LINE OF SAID LOT #3, NORTH 86°28' 00" WEST,
11 . 32 FEET, THENCE LEAVING SAID SOUTH LINE, NORTH
09°57' 03" EAST, 192 . 60 FEET TO A POINT ON THE SOUTH
LINE OF BEAVERCREEK DRIVE, THENCE WITH SAID SOUTH
LINE, ALONG THE ARC OF A NON-TANGENT CURVE CONCAVE TO
THE NORTHEAST HAVING A RADIUS OF 125 . 00 FEET, A
DISTANCE OF 18 . 95 FEET (THE CHORD ACROSS SAID ARC
BEARS SOUTH 84°31' 33" EAST, 18 . 93 FEET) , THENCE
CONTINUING ALONG THE SOUTH LINE OF BEAVERCREEK DRIVE,
SOUTH 88°52 ' 09" EAST, 7 . 63 FEET, TO THE POINT OF
BEGINNING.
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 of this ordinance is at the
present time particularly suitable for the purposes and uses of
the R-3, High Density Single-Family Residential District, and
that such changes authorized hereby are reasonable and in
reasonable conformity with the existing uses and value of the
immediately surrounding properties .
ARTICLE 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .(
