Comes now the City of Cape Girardeau, Missouri, a Municipal Corporation of the State of Missouri, and states that it is the owner of all fee interest of record of the following described real property,being in Scott County,Missouri: PART OF THE NORTH HALF (N 1/2) OF THE NORTHWEST QUARTER (NW 1/4) OF SECTION 35, TOWNSHIP 30 NORTH, RANGE 13 EAST IN SCOTT COUNTY, MISSOURI, CONTAINING 61.991 ACRES (MORE OR LESS), DESCRIBED AS FOLLOWS: Commence at the Northwest corner of said Section 35 (nothing found— set 5/8" iron rod); thence S 00°00'00" W along the West Line of said Section 35, 647.16 feet to the Point of Beginning: thence S 89°48'25" E, 2721.18 feet; thence S 89°47'24" E, 1355.18 feet to a point in the East Line of the NW 1/4 of the NE 1/4 of said Section 35; thence S 00°09'30" E along the 1/4 1/4-Section Line, 160.01 feet; thence S 20°12'32" W, 574.64 feet to a point in the South Line of the NW 1/4 of the NE 1/4 of said Section 35; thence N 89°47'24"W along the 1/4 1/4-Section Line, 1151.93 feet to the Southwest corner of the NW 1/4 of the NE 1/4 of said Section 35; thence N 89°48'25" W along the 1/4 1/4-Section Line, 1885.69 feet; thence N 74°02'52" W, 874.33 feet to a point in the West Line of said Section 35; thence N 00°00'00" E along the West Line of said Section 35, 462.54 feet to the Point of Beginning. 2. The City of Cape Girardeau, Missouri, does hereby petition to have the above described real property annexed to and included within the city limits of the City of Cape Girardeau,Missouri. 3. This Petition shall be a continuing obligation running with the land, and shall bind the subsequent owners as well as any heirs, executors, administrators, successors, assigns, and legal representatives of the current or subsequent owners. It is understood that this Petition will be recorded in the Office of the Recorder of Deeds of Scott County,Missouri, and shall be of record. WHEREFORE, the City of Cape Girardeau, Missouri, agrees that the City Council of the City of Cape Girardeau, Missouri, should extend the limits of the City of Cape Girardeau, Missouri, by ordinance to include the above described real property, taking whatever action necessary to facilitate said annexation so as to include said real property within the city limits of the City of Cape Girardeau,Missouri. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Further,, the City Council hereby finds and determines that with respect to the tract to be annexed into the City of Cape Girardeau, Missouri,, that all of the owners of all fee interest of record have requested such annexation by appropriate Petition. ARTICLE 3. The City Clerk is authorized and directed to cause three ( 3 ) certified copies of this ordinance in its final form to be filed with the Clerk of Cape Girardeau County as provided by Section 71.012 RSMo. ARTICLE 4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions thereof.
