KNOW ALL MEN BY THESE PRESENTS: The City Of Cape Girardeau,
Missouri, a Municipal Corporation, in consideration of the sum of One Dollar ($1.00) and
other good and valuable consideration, the receipt of which is hereby acknowledged, does
hereby grant, bargain, sell and convey to Union Electric Company d/b/a Ameren
Missouri hereinafter referred to as "Ameren", the right, privilege, permission and
authority to enter on and upon the following described property which is solely owned by
the undersigned located in the City and County of Cape Girardeau, Missouri, to -wit:
Part of the tract of land described in Deed Book 1332 on Page 582 to The City of
Cape Girardeau in the Cape Girardeau County Recorder's Office, also being part of the
South Half of Section 13, Township 31 North, Range 13 East, of the 5t' Principal
Meridian, Cape Girardeau County, Missouri, more particularly described as follows:
Commencing at the northwest corner of said City of Cape Girardeau tract; thence
North 82 degrees 51 minutes 09 seconds East along the northerly line of said tract, 15.12
feet to the Point of Beginning.
From said Point of Beginning; thence continuing North 82 degrees 51 minutes 09
seconds East along said northerly line, 20.16 feet; thence South 00 degrees 01 minutes 56
seconds East, 171.72 feet; thence southwesterly along a curve to the right where said
curve bears South 06 degrees 02 minutes 50 seconds West a distance of 285.15 feet with
a radius of 1,790.54 feet and an arc length of 285.45 feet; thence South 10 degrees 36
minutes 51 seconds West, 31.62 feet; thence South 89 degrees 09 minutes 27 seconds
East, 10.15 feet; thence South 10 degrees 36 minutes 51 seconds West, 20.29 feet; thence
North 89 degrees 09 minutes 27 seconds West, 10.15 feet; thence South 10 degrees 36
minutes 51 seconds West, 70.10 feet; thence southeasterly on a curve to the left on a
curve that bears South 01 degrees 06 minutes 59 seconds East, 221.70 feet with a radius
of 499.00 feet and arc length of 223.56 feet to the south line of said City of Cape
Girardeau tract; thence North 89 degrees 09 minutes 27 seconds West along said
southerly line, 20.66 feet; thence northwesterly along a curve to the right that bears
North 00 degrees 50 minutes 09 seconds West, 225.25 feet with a radius of 519.00 feet
and an arc length of 227.05 feet; thence North 10 degrees 36 minutes 51 seconds East,
121.83 feet; thence northeasterly along a curve to the left on a curve that bears North 06
degrees 03 minutes 05 seconds East, 281.70 feet with a radius of 1,770.54 feet and an arc
length of 282.00 feet; thence North 00 degrees 01 minutes 56 seconds West, 168.96 feet
to the Point of Beginning.
Said tract contains 16,228 square feet or 0.3725 acres, more or less.
Said right, privilege, permission and authority to enter in and upon said property
above described is granted for the purpose of enabling Ameren, its agents, servants and
assigns, to build, maintain, construct, operate, and repair electric lines from time to time,
in, on, upon, or across said described property, together with all the useful, necessary and
proper adjuncts, appurtenances, and appliances in connection therewith. This easement
and the right, privilege, permission and authority herein granted is perpetual and shall run
with the land.
The undersigned covenant that they are the owner in fee simple of the above
described property and have the legal right to convey same.
