AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 1134 NORTH SPRIGG STREET, IN THE CITY
AND COUNTY OF CAPE GIRARDEAU, MISSOURI, FROM R-4
TO C-1
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this Ordinance from R-4, Medium Density Multifamily
Residential District, to C-1, General Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Tuesday, September 8, 2020 ; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-4, Medium Density Multifamily Residential
District, to C-1, General Commercial District .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-4, Medium Density Multifamily
Residential District, to C-1, General Commercial District, for
the following described property:
1134 North Sprigg Street
Lot Five (5) in Block Four (4) of Marble City Heights
Addition, a subdivision in the City and County of Cape
Girardeau, Missouri, as shown by plat recorded in Plat
Book 2 at Page 36 .
Also, a parcel of land being all of Lots 1, 2, 3, 4, 17
and 18 in Block 4 of Marble City Heights Addition, as
shown by plat recorded in Plat Book 2 at Page 36, and
all of the vacated portion of Ruby Street abutting
Lots 1 and 18 and all of the vacated portion of the
alley abutting Lots 1, 2, 17 and 18 ' and all of the
East half of the portion of the vacated alley abutting
Lots 3 and 4, all being in the City and County of Cape
Girardeau, Missouri, described as follows : Begin at
the Southeast corner of said Lot 4, Block 4, of said
subdivision; thence northerly along the East R/W line
of Frederick Street, 230 . 0 feet to the North line of
vacated Ruby Street; thence westerly with the said
North line, 365 . 0 feet to the East R/W line of Sprigg
Street; thence southerly along said East R/W line,
130 . 0 feet to the Southwest comer of said Lot 17,
Block 4 of said subdivision; thence easterly and
perpendicular with the East line of Sprigg Street,
182 . 5 feet to the center of an alley, now vacated;
thence southerly parallel with the East line of Sprigg
Street and with the centerline of said alley, 100 . 0
feet; thence easterly along the South line of said Lot
4, 182 . 5 feet to the point of beginning.
Less and except the West 2 . 5 feet of Lots Three (3) ,
Four (4) and Five (5) in Block Four (4) of Marble City
Heights Addition, a subdivision in the City and County
of Cape Girardeau, Missouri, as shown by plat recorded
in Plat Book 2 at Page 36 AND all of the East one-half
(1/2) of the portion of the vacated alley abutting the
West side of said Lots Three (3) , Four (4) , and Five
(5) , being a strip of land Ten (10) feet wide East-
West and One Hundred Fifty (150) feet long North-
South.
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of the C-1,
General Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
ARTICLE 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
