AN ORDINANCE ADOPTING THE NATIONAL INCIDENT
MANAGEMENT SYSTEM AS THE STANDARD FOR
INCIDENT MANAGEMENT, BY THE CITY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, Federal Homeland Security Presidential Directive
(HSPD) 5 establishes the National Incident Management System
(NIMS); and
WHEREAS, NIMS establishes a single, comprehensive approach
to domestic incident management to ensure that all levels of
government across the nation have the capability to work
efficiently and effectively together using a national approach to
domestic incident management; and
WIIEREAS, NIMS provides a consistent nationwide approach for
federal, state, and local governments to work together to prepare
for and respond to, and recover from domestic incidents
regardless of the cause, size or complexity; and
WHEREAS, to facilitate the most efficient and effective
incident management it is critical that Federal, State, and local
organizations utilize standardized terminology, standardized
organizational structures, interoperable communications,
consolidated action plans, unified command structures, uniform
personnel qualification standards, uniform standards for
planning, training, and exercising, comprehensive resource
management, and designated incident facilities during emergencies
or disasters; and
WHEREAS, the NIMS standardized procedures for managing
personnel, communications, facilities and resources will improve
the City's ability to utilize federal funding to enhance local
agency readiness, maintain first responder safety, and streamline
incident management processes; and
WHEREAS, the Incident Command System components of NIMS are
already an integral part of various City incident management
activities, including current emergency management training
programs; and
WHEREAS, the City Council of the City of Cape Girardeau
desires to adopt the NIMS.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council hereby adopts the National
Incident Management System (NIMS) as the City standard for
incident management.
ARTICLE 2. In furtherance of NIMS, it is the policy of this
City to train officials and employees responsible for emergency
management.
ARTICLE 3. Directs that incident managers and response
organizations in our jurisdiction train and exercise the Incident
Command System (ICS) and use it in their response operations.
ARTICLE 4. In law enforcement related matters, the Cape
Girardeau Police Department will assume Incident Command until
otherwise delegated or transferred. In fire, emergency medical,
emergency management, and rescue related matters, the Cape
Girardeau. Fire Department will assume Incident Command until
otherwise delegated or transferred. In situations requiring
multi -agency or department response, Unified Command or Area
Command shall be established.
ARTICLE, 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
