Sags AN ORDINANCE AMENDING CHAPTER 25 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, REGARDING EXTERIOR LIGHTING BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. Article III, entitled "Exterior Lighting Standards", of Chapter 25 of the Code of Ordinances of the City of Cape Girardeau, Missouri, reading as follows: ARTICLE III. - EXTERIOR LIGHTING STANDARDS Sec. 25-301. - Purpose. The purpose of this section is to regulate the placement and arrangement of exterior lighting. These regulations are intended to: protect the public health, safety, and general welfare; enable the fair and consistent enforcement of these regulations; control- light spillover and glare; encourage lighting systems which conserve energy and costs; preserve community character; and provide for nighttime safety, utility, security, and prodi;lct.i vity. Sec. 25--302. - Exterior lighting objective. Li.ght:ing arrangements shall be arranged in the following manner: (a) To minimize light spillover onto any adjacent premises; and (b) So that light from any illuminated source be so shaded, shielded or directed that the light intensity or brightness will not adversely affect adjoining property. Sec. 25-303. - Exterior lighting standards. All exterior lighting upon any premises, regardless of zoning classification, shall be subject to the following conditions and limitation: (a) When a light source or luminaire does not have a cutoff the following standards shall be met: (1) Maximum mounting or pole height of the light source or luminaire: Fifteen (15) feet. (2) Maximum permitted lumination: 1 a. Three -tenths (0.3) footcandle at any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way of seventy (70) feet or less. b. One (1.0) footcandle at any other point along the perimeter of the property. (b) When a light source or luminaire has total cutoff of light at an angle so that the bare bulb, lamp, or light source is completely and opaquely shielded from the direct view of an observer at ground level at the perimeter of the property, the following standard shall be met: (1) Maximum .mounting or pole height of the light source or luminaire: Sixty (60) feet. (2) Maximum permitted lumination: a. One-half (0.5) footcandle at the any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way seventy (70) feet, or less. b. One (1.0) footcandle at any other point along the perimeter of the property. (c) Building and landscape light fixtures, including ground lighting for signs, flag poles, and statues, shall be equipped with shields or shutters to minimize spillover. The maximum permitted lamination as a result of reflected light resulting from such fixtures shall be: (1) One-half (0.5) footcandle at any point along the perimeter of the property where it adjoins a residential zoning district or is separated from a residential zoning district by a right-of-way of seventy (70) feet or less; and (2) One (1.0) footcandle at any other point along the perimeter of the property. (d) The maximum permitted average illumination of all parking lots shall be five (5) footcandles. (e) There shall be no lighting of a blinking, flashing, rotating or fluttering nature, including changes in light intensity, brightness, or color except for public safety purposes. (f) Light sources or luminaries shall not be located within bufferyard areas except on pedestrian walkways. 2 (g) A site lighting plan for uses requiring site plan review shall be submitted and shall provide the following information: (1) Proposed location on premises of all exterior light fixtures. (2) Description of illumination devices, fixtures, lamps, supports, reflectors, and lens, mounting height and wattage. (3) Photometric design layout for the site of all illuminated vertical and horizontal surfaces showing the design footcandle levels. (4) For uses requiring site plan review, lighting shall be significantly reduced during nonoperational building hours, allowing only lighting necessary for security purposes. The lighting plan submitted for review shall note where this distinction occurs. Sec. 25-304. - Existing lighting. At such time that at least thirty (30) percent of a property's existing lighting fixtures are moved or replaced, the requirements of this section shall be met. Sec. 2.5-305. - Exemptions. (a); Outdoor recreational use. Because of their unique requirements for nighttime visibility and their limited hours of operation, ball diamonds, playing fields, and tennis courts shall be exempt from the exterior lighting standards of section 25-303 above. These outdoor recreational uses must meet all other requirements of this section and of this chapter. (b) Private outdoor lights. Private outdoor lights installed by a public utility on private property for security purposes are exempt from the exterior lighting standards above, provided the installation is approved by all property owners of residential property from which the light source can be viewed directly. (c) Public street lighting. Street lights shall be exempt from the exterior lighting standards above. (d) Emergency warning lights. Safety signals and warning device lighting shall be exempt from the exterior lighting standards above. (e) Temporary seasonal/holiday lighting. Temporary seasonal/holiday lighting is exempt from the exterior lighting standards above. 3 (f) Search lights. Search lights for promotional purposes and special events shall be exempt from the exterior lighting standards above, provided the lights are not located in a residential zoning district and the lights are directed so that they do not illuminate any structure that is not located on the same property as the lights. Secs. 25-306-25-400. - Reserved and a new Article III, entitled "Exterior Lighting", is hereby enacted in lieu thereof, in words and figures, to read as follows, to -wit: ARTICLE III. - EXTERIOR LIGHTING Sec. 25-301. - Applicability. The requirements of this installation, alteration, and lighting except the following: article shall apply to the replacement of all exterior (a) Traffic control, emergency, and safety warning devices; (b) Street lights, as authorized by the city manager; (c) Security lights owned by a public utility; (d) Stadium lights and other lights used to illuminate an outdoor sports or recreation facility, excluding building and parking lot lights; (e) Temporary lights used to illuminate a construction site or displayed as part of a holiday season, community awareness program, or special event, excluding search lights; (f) Temporary search lights used to promote a special event, in nonresidential districts only; and (g) The alteration or replacement of no more than thirty (30) percent of the total number of exterior lights on an individual development site within a twelve (12) consecutive month period. Sec. 25-302. - Exterior lighting plan required. An exterior lighting plan shall be submitted to the city manager for any project involving the installation of new lighting or the alteration or replacement of existing lighting. The exterior lighting plan shall include a photometric plan, specifications for each proposed light fixture type, and any other necessary information as determined by the city manager. M Light fixtures and sources located on an individual single- family or two-family (duplex) lot shall be exempt from this requirement. Sec. 25-303. - Exterior lighting standards. (d) Wallpacks, floodlights, and other types of light fixtures mounted on a building or at or near ground level shall be equipped with shields, shutters, or other devices that minimize glare and spillover. The city manager may require such devices on other types of lights in order to prevent a traffic hazard or condition dangerous to the public safety. (e) Light sources that, by design or modification, change in brightness, intensity, or color shall be prohibited. Light dimming systems and electronic sign face lights shall be exempt from this requirement. (f) Small light fixtures with low -output light sources such as coach lights, lantern lights, sconce lights, and path lights shall be exempt from the requirements of section 25-303(c), (d), and (e). 5 Secs. 25-304-25-400. - Reserved. ARTICLE 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. ARTICLE 3. It is the intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention.
