AN ORDINANCE VACATING THE CITY'S
INTEREST IN PART OF AN UNIMPROVED ALLEY
RIGHT-OF-WAY BEHIND 621 AND 623 PERRY
AVENUE, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the City Council has received a request from
R. Hetzel Properties, LLC, West Broadway Properties, LLC,
and Gabe Wunderlich, for vacation in part of an unimproved
alley right-of-way running behind 621 and 623 Perry Avenue,
which is south of Woodlawn Avenue, in the City of Cape
Girardeau, Missouri; and
WHEREAS, a public hearing was held on March 16, 2020,
at 7:00 pm, at which time all interested parties were
afforded the opportunity to speak in favor of or in
opposition to the proposed vacation; and
WHEREAS, at least ten days notice of the time and
Place of this hearing was published in a newspaper of
general circulation in the City; and
WHEREAS, the City Council has determined that said
Property is not necessary or needed for any of the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the
property described above be vacated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council hereby finds that it is
in the public interest that the aforementioned property be
vacated.
ARTICLE 2. The City's interest in the following
described real estate:
AN ALLEY BEING PART OF BLOCK 1 OF WHITELAW
SUBDIVISION AS RECORDED IN PLAT BOOK 4 AT PAGE 7
IN THE LAND RECORDS OF CAPE GIRARDEAU COUNTY,
MISSOURI, AND THAT PART OF A VACATED ALLEY IN
CITY MANAGER FORM ORDINANCE NUMBER 106, ALL IN

THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF
MISSOURI DESCRIBED AS FOLLOWS:
BEGINNING at the Northwest Corner of Lot 7, Block
1 of the aforementioned Subdivision; thence South
06052159" West, along the West line thereof
extended, 108.01 feet to a point in the Centerline
of a vacated alley as shown in City Manager Form
Ordinance #106; thence North 83006'18" West, along
said Centerline, 16.00 feet to a point; thence
North 06°52159" East, along the East Line of Lots
15 and 16 extended of said Block 1, 108.01 feet
to the Northeast Corner of said Lot 16; thence
South 83007101' East, 16.00 feet to the POINT OF
BEGINNING and containing 1728 square feet, more or
less
ARTICLE 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
