AN ORDINANCE VACATING THE CITY'S
INTEREST IN AN UNIMPROVED ALLEY BETWEEN
414 AND 418 INDEPENDENCE STREET, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, a public hearing was held on March 16, 2020,
at 7:00 pm, at which time all interested parties were
afforded the opportunity to speak in favor of or in
opposition to the proposed vacation; and
WHEREAS, at least ten days notice of the time and
place of this hearing was published in a newspaper of
general circulation in the City; and
WHEREAS, the City Council has determined that said
property is not necessary or needed for any of the purposes
for which it was dedicated and established; and
WHEREAS, it is in the public interest that the
property described above be vacated.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
.ARTICLE 1. The City Council hereby finds that it is
in. the public interest that the aforementioned property be
vacated.
ARTICLE 2. The City's interest in the following
described real estate:
Leqal Description for 414 Independence
The alley between Lot 11 and Lot 14, Range "C",
and bounded on the south by Independence Street
and extending north from Independence Street
231.8 feet in the city of Cape Girardeau,
Missouri, described more fully as follows:
Begin at the southeast corner of Lot 14, Range
"C" at a point where the east line of Lot 14
intersects the north line of Independence Street;

thence in a general northerly direction parallel
with Fountain Street and along the east line of
Lot 14, 231.8 feet to a point; thence in a
general easterly direction parallel with
Independence Street, 17.12 feet for a point;
thence in a general southerly direction parallel
with Fountain Street, along the west line of Lot
11, Range "C", 231.8 feet to a point on the north
line of independence Street, which point is 180
feet west of the intersection of Independence
Street and Fountain street for a point; thence in
a general westerly direction along the north line
of Independence Street, 17.12 to the point of
beginning.
ARTICLE 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
