AN ORDINANCE DECLARING AN EMERGENCY AND
APPROPRIATING MONIES FOR OPERATING AND
CAPITAL EXPENDITURES IN RESPONSE TO THE
JANUARY 2020 CYBER ATTACK, FROM THE
EMERGENCY RESERVE FUND FOR THE FISCAL YEAR
ENDING JUNE 30, 2020, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Pursuant to Section 6.12 of the City Charter, the
Mayor and the City Council hereby unanimously declares that an
emergency situation exists in the City as a result of the cyber
attack which occurred in January 2020, due to the fact that it is a
condition beyond the control of the City Council, which has had the
effect of causing a significant increase in costs to the City.
ARTICLE 2. Pursuant to Sections 6.08(4) and 6.12 of the City
Charter, the Mayor and the City Council hereby unanimously
appropriate monies for operating and capital expenditures in
response to the January 2020 cyber attack, from the Emergency
Reserve Fund for actual expenses up to Five Hundred Thousand
Dollars ($500,000.00) for the fiscal year ending June 30, 2020.
ARTICLE 3. Pursuant to Section 3.15(c) of the Charter of the
City of Cape Girardeau, Missouri, this measure is adopted as an
emergency measure as it constitutes a Bill concerning an
appropriation for the payment of current expenses of City
Government, including emergency appropriations as provided in
Section 6.08 of the City Charter. Accordingly, this ordinance will
take effect immediately upon its
passage and approval.
