THE CITY'S INTEREST IN AVENUE RIGHT-OF-WAY STREET TO THE SOUTH TO THE NORTH, IN THE MISSOURI WHEREAS, the City Council has received a request from Ann Hudson, for vacation of unimproved Caruthers Avenue right-of-way lying between Dunklin Street to the south and New Madrid Street to the North, in the City of Cape Girardeau, Missouri; and WHEREAS, a public hearing was held on May 21, 2018, at 7:00 pm, at which time all interested parties were afforded the opportunity to speak in favor of or in opposition to the proposed vacation; and WHEREAS, at least ten days notice of the time and place of this hearing was published in a newspaper of general circulation in the City; and WHEREAS, the City Council has determined that said property is not necessary or needed for any of the purposes for which it was dedicated and established; and WHEREAS, it is in the public interest that the property described above be vacated. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Council hereby finds that it is in the public interest that the aforementioned property be vacated. ARTICLE 2. The City's interest in the following described real estate: THAT PART FOSTER-COBBEL'S FIRST SUBDIVISION, BEING A SUBDIVISION OF LOTS 17, 18, 21, AND 22 OF WALKER'S SUBDIVISION, AS SHOWN IN PLAT BOOK 4, PAGE 54, BEING PART OF OUTLOT 60 IN U.S.P.
