TEMPORARY CONSTRUCTION EASEMENT

THIS INDENTURE, Made on this day of tkfk- �4 '2018,
by and between TMK GROUP, LLC, a Missouri Limited Liability Cdmpany, herein referred to as
GRANTOR, and the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation of
the County of Cape Girardeau, State of Missouri, herein referred to as GRANTEE:
WITNESSETH, That said Grantor, in consideration of the sum of One Dollar ($1.00), and
other good and valuable consideration, to be paid by Grantee, the receipt of which is hereby
acknowledged, does by these presents, remise and convey unto Grantee the following temporary
construction easement on the property located at 106 S. Broadview Street, in the City of Cape
Girardeau, described as follows:

THAT PART OF U.S.P. SURVEY NO. 2199, IN THE NORTHWEST QUARTER OF
SECTION 1, TOWNSHIP 30 NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL
MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
Commence at the Southwest Corner of Lot No. 4 of the Resubdivision of Lot No. 21 of
Independence West Commercial Subdivision in the City and County of Cape Girardeau,
State of Missouri; thence South 86° 03' 02" East, with the South line of said Lot No. 4,
172.92 feet; thence North 00° 02' 01" East 34.30 feet to the point of beginning; thence
North 00° 02' 01" East, 3.03 feet; thence North 04° 02' 18" East, 32.30 feet; thence North
85° 58' 43" West, 4.00 feet; thence North 04° 01' 17" East, 20.91 feet; thence North 23°
09' 33" West, 19.09 feet; thence North 44° 18' 00" West, 15.22 feet to a point of the
North line of said Lot No. 4 being also the South right of way line of Independence
Street; thence North 83° 42' 31" West along said South right of way line 13.62 feet;
thence South 03° 17' 54" West, 57.14 feet; thence South 860 47' 32" East, 10.00 feet;
thence South 02° 24' 10" West, 28.00 feet; thence South 88° 23' 44" East, 26.41' to the
point of beginning and containing 2430.05 square feet.
Said right, privilege, permission and authority to enter in and upon said property above
described is granted for the purpose of enabling the City, its agents, servants and assigns, to use
said property to excavate, build, and construct from certain improvements, in, on, upon, or across
said described property, together with all the useful, necessary and proper adjuncts,
appurtenances, and appliances in connection therewith, as shown on the plans and specifications
on file in the Office of the City Engineer. Said privilege is valid from the date the easement is
accepted by City Council through the date right of way improvements are accepted by City
Council.
The undersigned covenant that he is the authorized representative of TMK Group, LLC,
the owner in fee simple of the above described property and has the legal right to convey same.
