AN ORDINANCE ACCEPTING A PERMANENT
UTILITY AND SEWER EASEMENT FOR
UNIMPROVED DECATUR STREET RIGHT-OF-WAY,
IN THE CITY OF CAPE GIRARDEAU, MISSOURI
•
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City of Cape Girardeau, Missouri,
hereby accepts, and agrees to accept a permanent utility
and sewer easement for unimproved Decatur Street Right-of-
Way, in the City of Cape Girardeau, Missouri, described as
follows:
PERMANENT UTILITY AND SEWER EASEMENT
THAT PART OF GIBONEY-HOUCK FIRST SUBDIVISION IN
SURVEY 2199, TOWNSHIP 30 NORTH, RANGE 14 EAST OF
THE FIFTH PRINCIPAL MERIDIAN, CITY AND COUNTY OF
CAPE GIRARDEAU MISSOURI, STATE OF MISSOURI, BEING
MORE PARTICULARLY DESCRIBED AS FOLLOWS :
Beginning at the Southwest Corner of Lot 10, of
Giboney-Houck First Subdivision, as shown in Plat
Book 1, Page 12 of the Land Records of Cape
Girardeau County, Missouri; thence N 43°42' 21" E,
along the Southeasterly Right of Way line of
Decatur Street (unconstructed) , 363 . 87 feet;
thence N 01°30' 02" E, 54 .29 feet to a point on
the South Right of Way Line of Missouri State
Highway 74; thence N 82°32' 48" W, along said
Right of Way, 5 . 87 feet; thence N 28°29' 19" W,
19. 74 feet; thence S 43°42' 21" W, 406. 65 feet to
a point on the Northeasterly Right of Way Line of
Willow Street; thence S 46°17' 39" E, 60 .00
feet to the Point of Beginning containing 0 . 5394

ARTICLE 2 . This ordinance shall be in full force and
effect ten days after its passage and approval .
