AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
BY CHANGING THE ZONING OF PROPERTY LOCATED AT 835
BEAUDEAN LANE, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI, FROM R-2 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this Ordinance from R-2, Single-Family Urban Residential
District, to R-4, Medium Density Multifamily Residential
District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, April 2, 2018; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-2, Single-Family Urban Residential District, to
R-4, Medium Density Multifamily Residential District .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-2, Single-Family Urban Residential
District, to R-4, Medium Density Multifamily Residential
District, for the following described property:
THAT PART OF OUTLOT NO. 45 IN U. S. SURVEY 2199, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS :
COMMENCING AT THE SOUTHEAST CORNER OF SAID OUTLOT NO.
45, THENCE NORTH 82°40 ' 14" WEST, 10 . 00 FEET TO THE
POINT OF BEGINNING; THENCE NORTH 82°40 ' 14" WEST, 656. 60
FEET; THENCE NORTH 06°46 ' 09" EAST, 413 . 26 FEET TO THE
SOUTH RIGHT OF WAY OF WALNUT STREET; THENCE WITH SAID
SOUTH RIGHT OF WAY, SOUTH 83°40 ' 13" EAST, 627 . 43 FEET;
THENCE SOUTH 38°46' 29" EAST, 34 . 50 FEET TO THE
INTERSECTION OF SAID SOUTH RIGHT OF WAY AND THE WEST

RIGHT OF WAY OF BEAUDEAN LANE; THENCE LEAVING SAID
SOUTH RIGHT OF WAY, AND WITH SAID WEST RIGHT OF WAY,
SOUTH 06°07 ' 15" WEST, 400 . 36 FEET TO THE POINT OF
BEGINNING, AND CONTAINING 6. 29 ACRES, MORE OR LESS, AND
BEING SUBJECT TO ANY EASEMENTS OF RECORD.
ARTICLE 2 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of the R-4,
Medium Density Multifamily Residential District, and that such
changes authorized hereby are reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
ARTICLE 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
