AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT THE SOUTHEAST CORNER OF SOUTH
WEST END BOULEVARD AND WALNUT STREET, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI,
FROM R-2 TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this Ordinance from R-2, Single-Family Urban Residential
District, to R-4, Medium Density Multifamily Residential
District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, March 5, 2018; and
WHEREAS, the City Council of the City of Cape Girardeau,
, Missouri, has elected to rezone the property described in
Article 1 from R-2, Single-Family Urban Residential District, to
R-4, Medium Density Multifamily Residential District .
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning of the property located at the southeast corner of
South West End Boulevard and Walnut Street, in the City and
County of Cape Girardeau, Missouri, from R-2, Single-Family
Urban Residential District, to R-4 , Medium Density Multifamily
Residential District, said area being the following described
property:
A PART OF OUTLOT 45 IN UNITED STATES PRIVATE SURVEY
2199, TOWNSHIP 30 NORTH, RANGE 14 EAST, OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
STATE OF MISSOURI, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS :
COMMENCE at the Southeast Corner of Lot 8 of Laring
Subdivision as Recorded in the Land Records of the

County Recorder' s Office in Plat Book 9 at Page16;
thence along the South line of Laring Subdivision, and
it' s prolongation, N 83°40' 13" W, 229. 96 feet to a
point on the West Right of Way Line of Beaudean Lane;
thence S 06°07' 15" W, 89 . 69 feet along said West Right
of Way Line; thence leaving said Right of Way Line, N
38°40' 13" W, 34 . 56 feet; thence N 83°40' 13" W, 631 . 57
feet to a point on the East Line of a tract of land as
recorded in Book 486 at Page 583; thence S 07°47' 11"
W, 65. 71 feet, along said East line to the Southeast
corner of said tract; thence N 83°33' 35" W, 155. 17
feet to the true POINT OF BEGINNING; thence S

feet to a point on the East Right of Way line of West

of Way, along a Curve to the. Right, having a Radius of
22 . 00 feet, a Length of 34 . 56 feet; thence S 83°22' 27"

of 430 . 00 feet, a Length of 259. 62 feet to a reverse
Curve having a Radius of 600 . 00 feet, a Length of
77 . 03 feet; thence departing from the aforementioned
Right of Way, S 83°33' 35" E, 139. 22 feet to the TRUE
POINT OF BEGINNING, containing 0 . 9606 Acres (41844
square feet) more or less .

ALL OF THAT PART OF OUTLOTS 45 AND 52 OF UNITED STATES
PRIVATE SURVEY NUMBER 2199, TOWNSHIP 30 NORTH, RANGE
14 EAST OF THE FIFTH PRINCIPAL MERIDIAN, IN THE CITY
AND COUNTY OF CAPE GIRARDEAU, MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BEGIN at a point on the common line between Outlots 45
and 52, at the east right of way line of South West
End Boulevard, thence with said east right of way
line, South 7°49' 38" West, 480 feet, more or less, to
the northwest corner of a tract of land conveyed to
the East Missouri Action Agency in Document 2010-
05893; thence North 48°57' 54" East with the north line
of said tract a distance of 273 . 78 feet to the
northern most corner of said tract, said point being
also the western most corner of a tract conveyed to
the Southeast Missouri Halfway House in Deed Book 509
at Page 88, thence with the westerly boundary line of

#45; said point also being the NW corner of said
Southeast Missouri Halfway House Tract, and also the
most southwesterly corner of a tract conveyed in Deed
Book 462 at Page 11, thence with the west line of said
tract, and the east line of a tract conveyed in
Document #2014-09342, North 33°58' 31" East, 181 . 60
feet, to the most northeasterly corner of a tract
conveyed in deed document 2014-09342; thence with the
north line of a tract conveyed in document #2014-
09342; North 81°30' 50" -West, parallel to the south
line of said Outlot #45, 428 feet, more or less, to a
point on the east line of said South West End
Boulevard, thence with said East line, South 7°49' 38"
West, 171 feet, more or less, to the place of
beginning and containing 3 . 79 acres, more or less .
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of the R-4,
Medium Density Multifamily Residential District, and that such
changes authorized hereby are reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
Article 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .
