HomeMy WebLinkAboutOrd.5061.02-19-2018 BILL NO. 18-17 ORDINANCE NO: _6i)6/ AN ORDINANCE VACATING THE CITY' S INTEREST IN - - A PUBLIC DRAINAGE EASEMENT AT 330 SIEMERS DRIVE, IN THE CITY OF CAPE GIRARDEAU, MISSOURI WHEREAS, the City Council has received a request from Sears Holding Corporation, to vacate a public drainage- easement running east from Siemers Drive right-of-way to Interstate-55 right of way, under the current Sears Building at 330 Siemers Drive, in the City of Cape Girardeau, Missouri; and WHEREAS, a public hearing was held on February 5, 2018, at 7 : 00 pm, at which time all interested parties were afforded the opportunity to speak in favor of or in opposition to the proposed vacation of the drainage easement; and WHEREAS, at least ten days notice of the time and place of this hearing was published in a newspaper of general circulation in the City; and WHEREAS, the City Council has determined that the drainage easement in question is not necessary or needed for any of the purposes for which it was dedicated and established; and WHEREAS, it is in the public interest that the drainage easement be vacated. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1 . The City Council hereby finds that it is in ,,the public interest that this drainage easement be vacated. ARTICLE 2 . The -City' s interest in the following described real estate: COMMENCING at the southeast corner of Lot 2 of Cape West 12th Subdivision, being in the west right-of-way of Interstate 55; runs thence with the right-of-way North 21 degrees 16 minutes 33 seconds West, 234 . 08 feet; thence 1 leaving the right-of-way South 68 degrees 43 minutes 27 seconds West, 30 . 00 feet to the POINT OF BEGINNING; thence through Lot 2 South 68 degrees 43 minutes 27 seconds West, 473. 41 feet to another easement in Lot 2; thence with this easement North 51 degrees 16 minutes 19 seconds West, 23 . 17 feet to an easement 20 feet from the front property line; thence with this easement North 21 degrees 16 minutes 33 seconds West, 19. 93 feet; thence through Lot 2 North 68 degrees 43 minutes 27 seconds East, 485 . 00 feet to an easement 30 feet from the back property line; thence with this property line South 21 degrees 16 minutes 33 seconds East, 40. 00 feet to the 'Point of Beginning; is hereby vacated.
