AN ORDINANCE ACCEPTING A PERMANENT UTILITY
EASEMENT FROM DEREK AND CARLA CORNELIUS, IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City of Cape Girardeau, Missouri,
hereby accepts a Permanent Utility Easement from Derek and
Carla Cornelius, in the City of Cape Girardeau, Missouri,
described as follows :
THAT PART OF LOT 2 OF GREATER CAPE GIRARDEAU
BUSINESS PARK PHASE II, AS RECORDED IN DOCUMENT
#2016-01887, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI AND DESCRIBED AS
FOLLOWS:
Commencing at the most Northeasterly corner of
Lot 2 of the Greater Cape Girardeau Business Park
Phase II; thence with the westerly right-of-way
of Business Park Place, along a curve to the
southeast, being concave to the northeast, having
a radius of 530 . 00 feet and an arc length of
70 . 44 feet (the chord of said arc bears South
32°56' 41" East for 70 . 39 feet) to a point in said
westerly right-of-way and being the point of
beginning; thence continuing along the curve of
said westerly right-of-way, a distance of 30 . 01
feet (the chord of said arc bears South 38°22' 27"
East for 30. 00 feet) ; thence leaving said right-
of-way, South 51°05' 06" West, 205 . 38 feet; thence
South 46°38' 21" East, 198 . 96 feet; thence South
43°21' 39" West, 107 . 58 feet; thence North
46°38' 21" West, 20 .00 feet; thence North
43°21' 39" East, 87 . 58 feet; thence North
46°38' 21" West, 211 . 95 feet; thence North
51°05' 06" East, 229. 92 feet, to the point of
beginning and containing 0 .29 acres (12, 586
square feet) more or less .

ARTICLE 2 . This ordinance shall be in full force and
effect ten days after its passage and approval .

PERMANENT UTILITY EASEMENT
Lot 2 Greater Cape Girardeau Business Park Phase II
KNOW ALL PERSONS BY THESE PRESENTS: DEREK AND KARLA CoRNELius, in
consideration of the sum of One Dollar ($1.00) and other good and valuable consideration, the receipt
of which is hereby acknowledged, do hereby grant, bargain, sell and convey to the CITY OF CAPE
GIRARDEAU, MISSOURI, a Municipal Corporation, hereinafter referred to as the "City", the right,
privilege, permission and authority to enter on and upon the following described property, located in
the City and County of Cape Girardeau, Missouri, to -wit:
THAT PART OF LOT 2 OF GREATER CAPE GIRARDEAU BUSINESS PARK PHASE II,
AS RECORDED IN DOCUMENT #2016-01887, IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI AND DESCRIBED AS FOLLOWS:
Commencing at the most Northeasterly corner of Lot 2 of the Greater Cape Girardeau
Business Park Phase II; thence with the westerly right-of-way of Business Park Place,
along a curve to the southeast, being concave to the northeast, having a radius of 530.00
feet and an are length of 70.44 feet (the chord of said arc bears South 32°56'41" East for
70.39 feet) to a point in said westerly right-of-way and being the point of beginning;
thence continuing along the curve of said westerly right-of-way, a distance of 30.01 feet
(the chord of said are bears South 38°22'27" East for 30.00 feet); thence leaving said
right-of-way, South 51°05'06" West, 205.38 feet; thence South 46°38'21" East, 198.96
feet; thence South 43°21'39" West, 107.58 feet; thence North 46°38'21" West, 20.00
feet; thence North 43°21'39" East, 87.58 feet; thence North 46°38'21" West, 211.95 feet;
thence North 51°05'06" East, 229.92 feet, to the point of beginning and containing 0.29
acres (12,586 square feet) more or less.
Said right, privilege, permission and authority to enter in and upon said property above
described is granted for the purpose of enabling the City, its agents, servants, and assigns to use said
property to excavate, build, and construct certain improvements, in, on, upon, or across said described
property, together with all the useful, necessary and proper adjuncts, appurtenances, and appliances in
connection therewith, as shown on the plans and specifications on file in the Office of the City
Engineer. The City shall repair all damage resulting from any activity by the City, its agents, servants,
and/or assigns pursuant to the right, privilege, permission and authority granted herein. This easement
and the right, privilege, permission and authority herein granted are perpetual and shall run with the
land.
The undersigned covenant that they are the owners in fee simple of the above described
property and have the legal right to convey the same.
