HomeMy WebLinkAboutOrd.5053.01-22-2018 BILL NO. 18-03 ORDINANCE NO. 501,53 AN ORDINANCE ACCEPTING A PERMANENT UTILITY EASEMENT FROM DEREK AND CARLA CORNELIUS, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1 . The City of Cape Girardeau, Missouri, hereby accepts a Permanent Utility Easement from Derek and Carla Cornelius, in the City of Cape Girardeau, Missouri, described as follows : THAT PART OF LOT 2 OF GREATER CAPE GIRARDEAU BUSINESS PARK PHASE II, AS RECORDED IN DOCUMENT #2016-01887, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI AND DESCRIBED AS FOLLOWS: Commencing at the most Northeasterly corner of Lot 2 of the Greater Cape Girardeau Business Park Phase II; thence with the westerly right-of-way of Business Park Place, along a curve to the southeast, being concave to the northeast, having a radius of 530 . 00 feet and an arc length of 70 . 44 feet (the chord of said arc bears South 32°56' 41" East for 70 . 39 feet) to a point in said westerly right-of-way and being the point of beginning; thence continuing along the curve of said westerly right-of-way, a distance of 30 . 01 feet (the chord of said arc bears South 38°22' 27" East for 30. 00 feet) ; thence leaving said right- of-way, South 51°05' 06" West, 205 . 38 feet; thence South 46°38' 21" East, 198 . 96 feet; thence South 43°21' 39" West, 107 . 58 feet; thence North 46°38' 21" West, 20 .00 feet; thence North 43°21' 39" East, 87 . 58 feet; thence North 46°38' 21" West, 211 . 95 feet; thence North 51°05' 06" East, 229. 92 feet, to the point of beginning and containing 0 .29 acres (12, 586 square feet) more or less . 1 ARTICLE 2 . The City shall repair all damage resulting from any activity by the City, its agents, servants, and/or assigns pursuant to the right, privilege, permission and authority granted herein. This easement and the right, privilege, permission and authority herein granted are perpetual and shall run with the land.
