AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 1927 NORTH KINGSHIGHWAY, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI,
FROM RMH TO R-4
WHEREAS, the City Planning and Zoning Commission has
recommended changing the zoning of property described in Article
1 of this Ordinance from RMH, Residential Manufactured Home
District, To R-4 , Medium Density Multifamily Residential
District, and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
November 6 , 2017, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described herein as
set out below;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to rezone
the following described property, located at 1927 North
Kingshighway, from RMH, Residential Manufactured Home District,
To R-4 , Medium Density Multifamily Residential District:
1927 North Kingshighway
Part of the East Half and part of the West Half of the
Northwest Quarter of Fractional Section 26, Township
31 North, Range 13 East, City and County of Cape
Girardeau, Missouri, described as follows:
Start at the Southwest corner of the east half of the
Northwest Quarter of Fractional Section 26, Township
31 North, Range 13 East, and run North 0 degrees 58'
West along the Quarter Quarter line 369 . 3 feet for the
Point of Beginning; thence South 79 degrees 28 ' West
836 . 8 feet; thence North 1 degree 13 ' West, 1305 . 6

feet to the southwest corner of a 10 . 2659 acre tract
of land conveyed by Warranty Deed Book 301 at page
237 ; thence along the boundary of said 10 . 2659 acre
tract the following courses and distances : South 71
degrees 04 ' East, 56 . 7 feet; thence South 40 degrees
06' East, 142 . 2 feet; thence South 56 degrees 40'
East, 188 . 5 feet; thence South 68 degrees 10' East,

200 . 0 feet to a point in the south right of way line

in the quarter quarter section line the east line of
the west half of the Northwest Quarter of said Section

quarter quarter line 860 . 76 feet to the Point of
Beginning.
Article 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof .
Article 3 . The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-4 ,
Medium Density Multifamily Residential District, and that such
designation authorized hereby is reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
Article 4 . This ordinance shall be in full force and
effect ten days after its passage and approval .
