HomeMy WebLinkAboutOrd.5022.11-20-2017PERMANENT WATER LINE EASEMENT KNOW ALL MEN BY THESE PRESENTS: THE HERITAGE PARK CONDOMINIUM ASSOCIATION, herein referred to as GRANTOR and the CITY OF CAPE GIRARDEAU, a Municipal Corporation of the County of Cape Girardeau, State of Missouri, herein referred to as GRANTEE: WITNESSTH, that the said Grantor, in consideration of the sum of One Dollar ($1.00), and other good and valuable consideration, to be paid by the Grantee, the receipt of which is hereby acknowledged, does by these presents, remise and conveys unto the Grantee, the following permanent water line easement at 1310 Lexington Avenue, located in the City of Cape Girardeau, as described as follows: DESCRIPTION OF EASEMENT A Tract Of Land Being A Part Of Lots 3 And 4 Of Brookshire Estates Third Subdivision, As Recorded In Plat Book 11 At Page 51 In The City And County Of Cape Girardeau, State Of Missouri, Being More Particularly Described As Follows: COMMENCE at a 3/8" Iron Pipe (found) at the Southwest corner of Lot 3 of the aforementioned subdivision, said point being the Northeast corner of Lexington Avenue and Amblewood Drive; thence N 89°32'32" E, along the North Right of Way Line of Lexington Avenue, 168.63 feet to the POINT OF BEGINNING; thence continue, N 89°32'32" E, 20.23 feet; thence N 09°07'02" W, 187.56 feet; thence S 65°09'39" W, 20.78 feet; thence S 09007'02" E, 178.88 feet to the POINT OF BEGINNING containing 3,664 square feet, more or less. TO HAVE AND TO HOLD, the same with all Rights, Immunities, Privileges and Appurtenances thereto belonging, unto the said Grantee, and its successors and assigns FOREVER, so that neither the Grantor, nor their successors and assigns, or any other person or entity, for them or in their names on behalf, shall or will hereafter claim or demand any right or title to the aforesaid premises, or any party thereof, but they and everyone of them shall, by these presents be excluded and forever barred. This easement and the right, privilege, permission and authority herein granted are perpetual and shall run with the land.
