PERPERTUAL NON-EXCLUSIVE EASEMENT FOR INGRESS AND EGRESS
KNOW ALL MEN BY THESE PRESENTS: JIM MUNGLE AND JANET MUNGLE,
TRUSTEES OF THE MUNGLE FAMILY TRUST OF AUGUST 22, 2007, hereinafter referred
to as "Grantor", in consideration of the sum of One Dollar ($$1.00) and other good and valuable
consideration, the receipt of which is hereby acknowledged, do hereby grant, bargain, sell and convey to
the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal corporation, hereinafter called the
"Grantee", the right, privilege, permission and authority to enter on and upon the following described
property, its permittees and assigns, which is solely owned by the undersigned located in the City and
County of Cape Girardeau, Missouri, to -wit:
An Easement for Ingress—Egress Being Described By Metes and Bounds As Follows:
A part of lot no. 3, of the resubdivision of lot no. 4, Kingshighway commercial addition as
recorded in plat book no. 15 at page no. 14 of the land records of the county recorder's
office, city and county of Cape Girardeau, state of Missouri being more particularly
described as follows:
Commencing at the southwest corner of lot no. 3 of said subdivision; thence s 82° 58' 56" e,
72.92 feet along the south line of said lot to the true point of beginning:
Said point being the beginning of a non -tangent curve, concave to the southeast, having a
radius of 42.00 feet, a central angle of 22° 43' 39" and from which a radial line bears, s 45°
53' 52" e; thence in a northeasterly direction along said curve, 16.66 feet; thence n 66° 49'
47" e, 40.37 feet to the beginning of a curve, concave to the northwest, having a radius of
50.00 feet, and a central angle of 13° 02'23"; thence in a northeasterly direction along said
curve, 11.38 feet; thence n 53° 47' 24" e, 6.50 feet to the beginning of a curve concave to the
northwest, having a radius of 50.00 feet, and a central angle of 30° 00' 00"; thence in a
northeasterly direction along said curve, 26.18 feet; thence n 23° 47' 24" e, 50.51 feet to the
beginning of a curve, concave to the southeast, having a radius of 50.00 feet and a central
angle of 29° 49' 04'; thence in a northeasterly direction along said curve, 26.02 feet; thence n
53° 36' 28" e, 53.18 feet to a point on the southwesterly right of way line of Kingshighway;
thence s 36° 23'32" e, 24.00 feet along said right of way line to a point; thence s 53° 36'28"
w, 70.92 feet to the beginning of a curve, concave to the southeast, having a radius of 50.00
feet and a central angle of 29° 49' 04"; thence in a southwesterly direction along said curve,
26.02 feet; thence s 23° 47'24" w, 23.18 feet to the beginning of a curve, concave to the
northwest, having a radius of 62.00 feet and a central angle of 30° 00' 00"; thence in a
southwesterly direction along said curve, 32.46 feet; thence s 53° 47'24" w, 6.50 feet to the
beginning of a curve concave to the northwest, having a radius of 62.00 feet and a central
angle of 13° 02' 23'; thence in a southwesterly direction along said curve, 14.11 feet; thence
s 66° 49'47" w, 40.37 feet to the beginning of a curve, concave to the southeast, having a
radius of 30.00 feet and a central angle of 02° 13'37"; thence in a southwesterly direction
along said curve, 1.17 feet to the south line of lot no. 3, Kingshighway commercial addition;
thence n 82° 58' 56" w, 17.42 feet to the point of beginning, containing 3,589 square feet,
more or less.
Said right, privilege, pertnission and authority to enter in and upon said property above
described is granted for the purpose of general access as a street or roadway to the Police Station.
This easement and the right, privilege, permission and authority herein granted is perpetual and shall
run with the land.
The undersigned covenant that they are the owners in fee simple of the above-described
property and have the legal right to convey this easement.

KNOW ALL MEN BY THESE PRESENTS: JIM MUNGLE AND JANET MUNGLE,
TRUSTEES OF THE MUNGLE FAMILY TRUST OF AUGUST 22, 2007, hereinafter referred
to as"Grantor", and the CITY OF CAPE GIRARDEAU, MISSOURI, a Municipal Corporation of
the County of Cape Girardeau, State of Missouri, herein referred to as GRANTEE:
WITNESSETH, that Grantors, in consideration of the sutra of One Dollar ($1.00), and other
good and valuable consideration, to be paid by Grantee, the receipt of which is hereby acknowledged,
do by these presents, remise and convey unto Grantee the following TEMPORARY
CONSTRUCTION EASEMENT on the property described as follows:
A part of lot no. 3, Kingshighway commercial addition as recorded in plat book 12 at page
34 and a part of lot no. 3 of the "resubdivision of lot no. 4, Kingshighway commercial
addition" as recorded in plat book 15 at page 14, City and County of Cape Girardeau, State
of Missouri being more particularly described as follows:
A strip of land 25.00 feet wide, lying north of the following described sideline:
Beginning at a point on the south line of lot no. 3, "Resubdivision of Lot No. 4,
Kingshighway Commercial Addition" from which the southwest corner thereof bears, n 82°
58' 56" w, 47.00 feet; thence s 82° 58' 56" e, 82.00 feet along the south line of said lot 3 to a
point and there terminating.
Said right, privilege, permission and authority to enter in and upon said property above
described is granted for the purpose of enabling the City, its agents, servants, and assigns to use said
property to excavate, build, and construct certain land improvements for the Police Station Project,
in, on, upon, or across said described property, together with all the useful, necessary and proper
adjuncts, appurtenances, and appliances in connection therewith, as shown on the plans and
specification of file in the Office of the City Engineer. Said privilege is valid from the date this
easement is accepted by the City Council through the date those improvements are accepted by the
City Council.
The undersigned covenants that it is the owner in fee simple of the above-described property
and has the legal right to convey this easement.
