AN ORDINANCE VACATING THE CITY' S INTEREST IN A
PERMANENT ACCESS EASEMENT IN WILDWOOD
SUBDIVISION, LOCATED IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, the City Council has received a request from property
owners that the City vacate a permanent access easement in Wildwood
Subdivision, and more particularly described in Section 1 hereof;
and
WHEREAS, the date of Monday, November 5 , 2007, was set for a
public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and place
of this hearing was published in a newspaper of general circulation
in the City; and
WHEREAS, a public hearing was held by the City Council on
Monday, November 5, 2007, at which all interested parties were
afforded the opportunity to speak in favor of or in opposition to
the proposed access easement vacation; and
WHEREAS, the City Council has determined that the access
easement in question is not necessary or needed for the purpose for
which it was dedicated and established; and
WHEREAS, it is in the public interest that the access easement
be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City' s interest in a certain access easement
on the following described real estate:
A tract of land in Wildwood Subdivision located in the
northwest quarter of Section 19, Township 31 North, Range
14 East in the City and County of Cape Girardeau,
Missouri, more particularly described as follows :
A 40 foot wide Access Easement that is 20 feet wide both
sides of the following described centerline:
Begin at the northwest corner of Lot No. 3 in Wildwood
Subdivision for a Point of Beginning, thence; South
26054136" West, along the lot line between Lot No. 3 and
Lot No. 4 , 307 . 02 feet to a point on north cul-de-sac
line of Turtle Lane .
is hereby vacated.
ARTICLE 2 . This ordinance shall be in full force and effect
ten days after its passage and approval .
