AN ORDINANCE ACCEPTING A PERMANENT SEWER
EASEMENT FROM WHISPERING OAKS OF CAPE GIRARDEAU,
LC, FOR MAINTENANCE OF SEWER "E" LOCATED IN
WHISPERING OAKS SUBDIVISION, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, hereby accepts a
Permanent Sewer Easement, executed by Whispering Oaks of Cape Girardeau,
LC, for maintenance of Sewer "E" located in Whispering Oaks Subdivision,
conveying to the City of Cape Girardeau, Missouri, the following described
real property, to-wit :
THAT PART OF LOT 83 OF THE MEADOWS OF WHISPERING OAKS-
AMENDED, A SUBDIVISION ON FILE IN THE LAND RECORDS OF CAPE
GIRARDEAU COUNTY IN PLAT BOOK 23 AT PAGE 62, ALSO BEING
PART OF FRACTIONAL SECTION 10, TOWNSHIP 31 NORTH, RANGE 13
EAST, CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI
DESCRIBED AS FOLLOWS:
Commence at the Northeast corner of Lot 83 of said
Subdivision; thence with the East line of said Lot South
170 51' 28" West, 59 .46 to the point of beginning; thence
continuing with said line South 17" 51' 28" West, 18 . 02
feet; thence leaving said line North 380 29' 00" West,
122 . 96 feet, to a point on the North line of said Lot 83 ;
thence with said line South 770 21' 04" East, 23 . 90 feet;
thence leaving said line South 380 29' 00" East, 94 . 37
feet, to the point of beginning and containing 1, 630
square feet, more or less, as shown on the plat attached
as Exhibit A.
ARTICLE 2 . This ordinance shall be in full force and effect ten days
s passage and approval.
