AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, BY CHANGING THE ZONING OF LOT 24 , BLOCK 2 , PARK PLACE SUBDIVISION, LOCATED AT 1330 BROADWAY, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI FROM R-2 to C-1 WHEREAS, the City Planning and Zoning Commission has recommended that all of the property described in Article 1 of this ordinance should be rezoned from R-2, Single-Family Dwelling District, to C-1, Local Commercial District; and WHEREAS, Public Notice of such change was given as prescribed in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, and public hearing was held on Monday, September 4 , 2007, and WHEREAS, the City Council of the City of Cape Girardeau, Missouri, has elected to rezone the property described in Article 1 from R-2, Single-Family Dwelling District, to C-1, Local Commercial District; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended to change the zoning from the present R-2, Single-Family Dwelling District, to C-1, Local Commercial District, for the following described property: All of Lots Numbered Twenty-four (24) , Twenty-five (25) and Twenty-six (26) in Block Numbered Two (2) of Park Place Addition to the City of Cape Girardeau, Missouri, as shown by Plat recorded in Plat Book 3 at Page 6, land records of Cape Girardeau County, Missouri . LESS AND EXCEPT all of that land conveyed to the City of Cape Girardeau in Missouri General Warranty Deed recorded April 26 , 2006 in Document Number 2006-05411 of the land deed records of Cape Girardeau County, Missouri . Article 2. The City Council hereby finds and declares that the property described in Article 1 hereof is at the present 1 time particularly suitable for the purposes and uses of a C-1, Local Commercial District, and that such changes authorized hereby are reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties . ticle 3 .
