AN ORDINANCE ACCEPTING A PERMANENT STORMWATER EASEMENT AND TEMPORARY CONSTRUCTION EASEMENTS FROM VARIOUS PROPERTY OWNERS FOR STORMWATER IMPROVEMENTS AT THE SILVER SPRINGS ROAD/THEMIS STREET INTERSECTION BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,AS FOLLOWS: ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts a Permanent Stormwater Easement executed by West Cape Development Corporation,conveying an easement to the City of Cape Girardeau,Missouri for stormwater improvements at the Silver Springs Road and Themis Street intersection,more particularly described as follows,to-wit: All of that part of Outlot 82 of U.S.Survey 2199,Township 31 North,Range 13 East of the Fifth Principal Meridian,City and County of Cape Girardeau,Missouri,described as follows: from the southwest comer of Lot 3 of Crites Sixth Addition as shown by plat on file in Plat Book 13 at Page 42 in the Cape Girardeau County lands records,said southwest comer being the point of beginning of an easement;said easement being a strip of land, 15.0 feet in width for the purpose of public utilities and drainage,coincident to, adjoining with and lying on the westerly side of the following described line;thence, N 2158' E along the westerly line of Lot 3 of said Crites Sixth Addition a distance of 38.0 feet and there terminating. ARTICLE 2. The City of Cape Girardeau, Missouri hereby accepts a Temporary Construction Easement executed by West Cape Development Corporation,conveying an easement to the City of Cape Girardeau,Missouri for stormwater improvements at the Silver Springs Road and Themis Street intersection,more particularly described as follows,to-wit. A temporary construction easement,10.0 feet in width,adjoining with and lying along the westerly side of the westerly boundary of the following described utilities and drainage easement All of that part of Outlot 82 of U.S.Survey 2199,Township 31 North, Range 13 East of the Fifth Principal Meridian,City and County of Cape Girardeau,Missouri,described as follows: From the southwest comer of Lot 3 of Crites Sixth Addition as shown by plat on file in Plat Book 13 at Page 42 in the Cape Girardeau County Lands Records,said southwest comer being the point of beginning of an easement;said easement being a strip of land, 15.0 feet in width for the purpose of public utilities and drainage,coincident to, adjoining with and lying on the westerly side of the following described line; thence,N Page 1 of 3 2558'E along the westerly line of Lot 3 of said Crites Sixth Addition a distance of 38.0 feet and there terminating. The City of Cape Girardeau,Missouri hereby accepts a Temporary Construction Easement executed by Rendrag Limited Partnership,conveying an easement to the City of Cape Girardeau,Missouri for stormwater improvements at the Silver Springs Road and Themis Street intersection,more particularly described as follows, to-wit: All of that part of Lots 3 and 4 of Crites Sixth Subdivision as shown by plat filed in Plat bBook 13 at Page 42 in the Cape Girardeau County Land Records and lying in the City and County of Cape Girardeau,Missouri,described as follows: From the northwest comer of Lot 4 of Crites Sixth Addition measure N 8546' E along the southerly right-of-way line of Themis Street a distance of 16.9 feet to the point of beginning; this easement being a strip of land,10.0 feet in width,coincident to, adjoining with and lying on the easterly side of the following described line;thence,S 2558' W parallel to the westerly line of said Lot 4 a distance of 45.0 feet and there terminating. ALSO: From the southwest comer of Lot 3 of said Crites Sixth Subdivision measure N 8546' E along the northerly right-of-way line of Themis Street a distance of 16.9 feet to the point- of-beginning of a temporary construction easement;said easement being a strip of land, 10.0 feet in width,coincident to,adjoining with and lying on the easterly side of the following described line;thence,N 2558' E parallel to the westerly line of said Lot 3 a distance of 30.0 feet and there terminating. ARTICLE 4. The City of Cape Girardeau,Missouri hereby accepts a Temporary Construction Easement executed by C&H Group,LLC,conveying an easement to the City of Cape Girardeau,Missouri for stormwater improvements at the Silver Springs Road and Themis Street intersection,more particularly described as follows,to-wit. All of that part of Lot 1 of Crites Seventh Addition to the City of Cape Girardeau as shown by plat filed in Plat Book 14 at Page 1 of the Cape Girardeau County Land Records and lying in the City and County of Cape Girardeau,Missouri,described as follows: From the northeast comer of Lot 1 of said Crites Seventh Addition measure S 8529' W along the southerly right-of-way line of Themis Street a distance of 16.9 feet to the point of beginning of a temporary construction easement;said easement being a strip of land, 10.0 feet in width,coincident to,adjoining with and lying on the westerly side of the following described line; thence,S 2558'W parallel to the easterly line of said Lot 1 a distance of 30.0 feet and there terminating.
