AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF A
PORTION OF AN EXISTING LOT IN THE 200 BLOCK
OF MT. AUBURN ROAD, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI FROM C-4 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Article 1 of
this ordinance should be rezoned from C-4 , Planned Commercial
District, to C-2, General Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, March 5, 2007; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
t Article 1 from C-4 , Planned Commercial District, to C-2, General
Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present C-4 , Planned Commercial District, to
C-2, General Commercial District, for the following described
property:
A PART OF LOT NO. 1, HSCA SUBDIVISION AS RECORDED IN
PLAT BOOK NO. 23 AT PAGE NO. 72 OF THE LAND RECORDS OF
THE COUNTY RECORDER' S OFFICE, LYING IN A PART OF
OUTLOT 85, UNITED STATES PRIVATE SURVEY NO. 2199,
TOWNSHIP 1430 NORTH, RANGE 13 EAST, OF THE FIFTH
PRINCIPAL MERIDIAN, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS :
Beginning at the southwest corner of Lot No. l, HSCA
Subdivision; thence N 190 35 ' 39" W, 86 . 38 feet along
the west line of said lot; thence N 870 10 ' 40" E,

239 . 37 feet to the southeast corner of said lot;
thence along the south line of said lot the following
courses and distances; S 290 50 ' 13" W, 148 . 86 feet to
the most southerly corner of said lot; thence N 590
52 ' 30" W, 104 . 78 feet; thence S 690 54 ' 04" W, 48 . 37
feet to the point of beginning.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of a C-2,
General Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
