LEGAL DESCRIPTION:
All the grantor's land lying in part of United States Private Survey No. 3090, Township 30
North, Range 13 East of the Fifth Principal Meridian, City and County of Cape Girardeau, State
of Missouri,being more particularly described as follows:
Commencing at the southeast comer of Lot 1 of Park West Hospitality Center No. 1 as recorded
in the land records of the County Recorder's Office in Plat Book 16 at Page 88, said point being
on the west right of way line of Mt. Auburn Road; thence along said right of way line N 4° 40'
07" E, 19.00 feet to the True Point of Beginning; thence continuing along said right of way line
N 4°40' 07"E, 6.00 feet; thence leaving said right of way line N 84 ° 17' 06", 3.00 feet; thence
S 4°40' 07"w, 6.00 feet; thence S 84° 17' 06" E, 3.00 feet to the point of beginning, containing
18 square feet more or less.

AN ORDINANCE VACATING THE CITY' S INTEREST IN
A PORTION OF RIGHT-OF-WAY ON MT. AUBURN
ROAD, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, the City Council has received a request from
property owners that the City vacate a portion of street right-
of-way located on Mt . Auburn Road, and more particularly
described in Article 2 hereof; and
WHEREAS, the City Council set the date of Monday, February
5, 2007, for a public hearing on this request; and
WHEREAS, at least ten (10) days notice of the time and
place of this hearing was published in a newspaper of general
circulation in the City; and
WHEREAS, a public hearing was held on February 5, 2007 at
which time all interested parties were afforded the opportunity
to speak in favor of or in opposition to the proposed Mt. Auburn
Road right-of-way vacation; and
WHEREAS, the City Council has determined that the right-of-
way in question is not necessary or needed for the purposes for
which it was dedicated and established; and
WHEREAS, it is in the public interest that the Mt . Auburn
Road right-of-way be vacated;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . The City Council hereby finds that it is in the
public interest to vacate that portion of the Mt . Auburn right-
of-way referred to in Article 2 herein.
ARTICLE 2 . The City' s interest in the Mt . Auburn Road
right-of-way on the following described real estate:
All the grantor' s land lying in part of United States

of Cape Girardeau, State of Missouri, being more
particularly described as follows :

ARTICLE 2 . This ordinance shall be in full force and effect
