HomeMy WebLinkAboutOrd.3775.01-08-2007 BILL NO. 06-259 ORDINANCE NO. 3 i S AN ORDINANCE DECLARING IT NECESSARY TO EXTEND CITY WATER SERVICES TO WHITE OAKS SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU, MISSOURI BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1 . That the Council of the City of Cape Girardeau, Missouri, hereby declares it necessary to extend city water services to White Oaks Subdivision, by installing 265 linear feet of 8" water main extension, replacing two (2) existing fire hydrants, installing one (1) new fire hydrant, installing 580 linear feet of 1" service line, incidental ditch work, and other necessary appurtenances, all as shown on the plans and specifications for said improvements which have been filed with the City Clerk. It is the intention of the City Council to have this project done by contract and upon completion of the project, the actual cost of the proposed work, including all engineering costs, shall be charged to the abutting property by the issuance of special tax bills . ARTICLE 2 . That this ordinance be published for seven consecutive insertions in the Southeast Missourian, a daily newspaper, printed and published in the City of Cape Girardeau, Missouri, and if a majority of the resident owners of the lands that would be liable for the costs of the improvements, at the date of the passage of this ordinance, who shall own a majority of the front feet owned by the residents of the City, abutting in White Oaks Subdivision proposed to be improved, shall not within ten days after the last publication of the ordinance, file with the City Clerk their protest against such improvements, then the City Council shall have the power to cause the improvements to be made, and assess the full costs against the property abutting on the improvements as provided by law. ARTICLE 3 . A public hearing will be held before the City Council at 7 : 00 P.M. on Monday, January 22, 2007, at City Hall, 401 Independence, Cape Girardeau, Missouri, at which time citizens and all interested parties may be heard on the question of the necessity of the work sought to be done . CITY OF CAPE GIRARDEAU, MISSOURI Office of the City Manager Council Letter No. 344 Agenda December 04, 2006 The Honorable Mayor and Members of the City Council City of Cape Girardeau, Missouri Subject: An Ordinance Declaring it Necessary to Extend City Water Services to the White Oaks Subdivision, Being A Special Assessment Project Dear Mayor and Council Members. In January, 2006 the White Oaks Homeowners Association requested the City of Cape Girardeau to design and contract for construction the necessary improvements to connect their subdivision to City water services. The scope of work is to extend the existing private water systems to existing City owned and operated systems by installing 265 linear feet of 8" water main extension, replacing two (2) existing fire hydrants, installing one new fire hydrant, installing 580 linear feet of 1" service line, and incidental ditch work. The street and associated stormwater collection devices are to remain under the private control of the Homeowners Association. The city is acquiring commitments from the property owners for all of the necessary easements and right-of-way for the above referenced project and future Bloomfield Road widening. Design plans are nearing completion and are under review by the homeowners. The estimated cost for this project is $39,000.00. This ordinance was established at the November 06, 2006 City Council *meeting and approved. However, the Southeast Missourian inadvertently left out this public hearing from its advertisements. Therefore to meet state statutes and create a legal assessment procedure, it is necessary to re -adopt an ordinance declaring it necessary to make the proposed improvement. To help expedite the process, it is recommended that the City Council give emergency reading consideration to the Ordinance ofNecessity, declaring it necessary to make the improvement and establishing December 18, 2006 as the date of the public hearing on this project.
