AN ORDINANCE AUTHORIZING ACCEPTANCE OF FEE SIMPLE
INTEREST FROM RUTH CAMPBELL EVANS,TRUSTEE OF THE RUTH
CAMPBELL EVANS REVOCABLE TRUST INDENTURE DATED
AUGUST 6, 1992, JANET ANN CAMPBELL DAME, TERRY DAME,
MARY ROSE CAMPBELL KEILBACH AND JOHN KEILBACH, FOR
WATER SYSTEM IMPROVEMENTS ADJACENT TO WATER PLANT
NO.2
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau,Missouri hereby accepts fee simple interest executed by
the Ruth Campbell Evans,Trustee of the Ruth Campbell Evans Revocable Trust Indenture dated August 6,
1992 and Janet Ann Campbell Dame and Terry Dame,and Mary Rose Campbell Keilbach and John
Keilbach,conveying property to the City of Cape Girardeau,Missouri for water system improvements
adjacent to Water Plant No. 2,more particularly described as follows,to-wit:
Part of Section 24,Township 30 North,Range 13 East,County of Cape Girardeau,State of
Missouri,described as follows: Start at the center of Section 19,Township 30 North,Range 14 East;
thence South 88 degrees 03'West,along the east-west quarter section line of said Section 19 the east-
west quarter section line of Section 24,Township 30 North,Range 13 East,3,960 feet the northeast
comer of the west half of the southeast quarter of said Section 24;thence South 1 degree 57'East,
on the east line of said west half,2,640 feet to the south line of said Section 24 on north line of Little
River Drainage District Ditch No. 2;thence South 88 degrees 03'West,on south line of Section 24,
1,073.69 feet to the point of beginning;thence continue South 88 degrees 03'West,on the south line
of Section 24, 179.81 feet to the center of the old Rock Levee Road;thence North 35 degrees 25'
West,with said Road 260.1 feet;thence North 31 degrees 51'West,with said Road,4,684.2 feet to
the south line of the Sc Louis and San Francisco Railroad;thence North 63 degrees 24'East,with
said south line,50.21 feet thence South 31 degrees 51'East,parallel and 50 feet east of the centerline
of old Rock Levee Road, 1,205.06 feet;thence North 63 degrees 24'East parallel and 1,200 feet
south of the south line of the St.Louis and San Francisco Railroad, 100.42 feet;thence South 31
degrees 51 East,parallel and 150 feet east of the centerline of old Rock Levee Road,3,460.69 feet
thence South 35 degrees 25'East,parallel and 150 feet east of the centerline of old Rock Levee
Road,354.59 feet to the point of beginning.
Except from the above legal that portion as shown in the Report of Commissioners filed November
20, 1980,Case No.CV680-674CC,in the Circuit Court of Cape Girardeau County,Missouri.
Grantors'Reserved Rights:
ARTICLE 2. The Council of the City of Cape Girardeau,Missouri,hereby finds and declares that
the acquisition of the above described properties is for a public use and that such acquisition is within the
scope of the authority or power of the City of Cape Girardeau,Missouri,and that the acquisition of the
property is reasonable and necessary for public use in order to provide for water system improvements
adjacent to Water Plant No. 2.
ARTICLE 3. This ordinance shall be in full force and fect ten days after its passage and approval.
