AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PROPERTY FOR THE BEND ROAD — MASON STREET —
MAIN STREET IMPROVEMENT PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,MISSOURI,AS
FOLLOWS:
ARTICLE 1. The City Staff is authorized and directed to acquire certain property needed for the
improvement of Bend Road—Mason Street—Main Street between Mill Street and East Cape Rock Drive. The City
staff is hereby authorized and directed to accept offers of donation of property needed,make appropriate offers of
purchase to the owners of the properties based on values provided by professional appraisers;to negotiate with the
owners of the property in an effort to reach agreement for the purchase of the property needed and if the
negotiations fail,then to proceed to acquire the needed properties through the exercise of the City's powers of
Eminent Domain. All of the above actions heretofore taken by City Staff relating to the following tracts are hereby
authorized and ratified by the City Council.
ARTICLE 2. The property designated for acquisition for this project are as follows:
TRACT 1.
GALE AND SHEILA WISDOM
FEE SIMPLE INTEREST
A part of the East Half of Lot Forty-seven (47) in Range"O"of Ingram's Addition in the City and County
of Cape Girardeau,Missouri,more particularly described by metes and bounds as follows:
Begin at the northeast comer of said Lot 47,being at the intersection of North Main Street and Mason
Street;thence nut South along the west line of Main Street a distance of 42 1/2 feet to the place of beginning;
thence continue south along the said west line of Main Street a distance of 42'/2 feet to the southeast comer
of said Lot 47;thence run West along the south line of said Lot 47 a distance of 91 '/2 feet to a point;thence
run North parallel with Main Street a distance of 85 feet to a point in the south line of Mason Street;thence
run east along the south line of Mason Street a distance of eight(8) feet to a point; thence nut south parallel
with Main Street a distance of 42'/2 feet to a point;thence run east parallel with Mason Street a distance of
83 1/2 feet to the place of beginning.
ALSO
All of the grantors'interest in and to all of the North Half of the East Half of Lot Forty-seven (47)in
Range"O"of Ingram's Addition in the City and County of Cape Girardeau,Missouri,described as follows:
Begin at the Northeast comer of said Lot No. 47,being at the intersection of North Main and Mason
Streets;thence South along the West line of Main Street 42'/2 feet;thence West 91.5 feet thence North 42
'/a feet to the South line of Mason Street thence East along the South line of Mason Street 91.5 feet to the
place of beginning. EXCEPT that part conveyed by Doyle K Vamum and Leola B.Vamum to Ethel K
Bechel and Wilma Bechel by Warranty Deed recorded in book 212 at page 469.

All the grantors'interest in and to all of the North 42.5 feet of the East 91.5 feet of Lot Forty-eight(48)in
Range"O"of Ingram's Addition in the City and County of Cape Girardeau,Missouri.

PEGGY CHILES AND WILLIAM PATTERSON
FEE SIMPLE INTEREST
Part of Lot Forty-seven (47)in Range"O"of Ingram's Addition to the City of Cape Girardeau,Missouri,
desscribed as follows:
Beginning at the Northwest comer of said Lot 47,being at the intersection of North Spanish and Mason
Street thence running East 91.5 feet along Mason Street thence South parallel with North Spanish Street
425 feet thence West parallel with Mason Street 91.5 feet to North Spanish Street thence North along
North Spanish Street 425 feet to the place of beginning.
ARTICLE 3. The Council of the City of Cape Girardeau,Missouri,hereby finds and declares that the
acquisition of the above described properties is for a public use and that such acquisition is within the scope of the
authority or power of the City of Cape Girardeau,Missouri,and that the acquisition of the properties is reasonable
and necessary for public use in order to provide for the improvement of a public street.
ARTICLE 4. This ordinance shall bein (full force and effect ten days after its passage and approval.
