AN ORDINANCE ACCEPTING A QUIT CLAIM DEED AND
ASSIGNMENT OF EASEMENTS, AND AN ASSIGNMENT,
FROM THE MAIN STREET LEVEE IMPROVEMENT
DISTRICT FOR THE TRANSFER OF THE MISSISSIPPI
RIVER FLOOD PROTECTION SYSTEM, TO THE CITY
OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The City of Cape Girardeau, Missouri, hereby
accepts a Quit Deed and Assignment of Easements, and an
Assignment, from the Main Street Levee Improvement District for
the transfer of the Mississippi River Flood Protection System,
in the City of Cape Girardeau, Missouri, conveying to the City
of Cape Girardeau, Missouri, the following described real
property, to-wit :
1 . DEED BOOK 165, PAGE 005
Located North of Bellevue Street that may be required
to construct, repair, operate, and maintain all the
works and improvements providing flood protection to
the area included within the boundary line of Grantee .
This easement, right privilege, permission and
authority to enter in and upon said right-of-way above
described is irrevocable and a covenant running with
the land and binding upon the Grantor and Grantee and
their respective successors in title.

That part of lot One in Range "D" of the City of Cape
Girardeau, Missouri, described as follows : Begin at
the Southeast comer of Subdivision Eight of "Painter
Partition" as shown in the plat of said "Painter
Partition" of record in the Recorders Office at
Jackson, Missouri; and thence run North along the West
side of Front Street a distance of ninety-two feet
five inches to a beginning point; thence run North
along the West side of Front Street a distance of
forty-five feet three and one half inches; thence
Westerly along the North side of the present brick
wall a distance of sixty-seven and one half inches;
thence run East along the South side of the present
brick wall now on side property a distance of sixty-
seven and one half feet to the place of beginning.

All that part of Lot 1, Range E, in the City of Cape
Girardeau, Missouri, fronting Forty-two (42) feet on
Broadway Street and Ninety-nine (99) feet on Main
Street, the same being located at the Northeast Comer
of the intersection of Main and Broadway Street .

All of that part of Lot One in Range "D" in the City
of Cape Girardeau, Missouri, described as follows :
Begin at a point ninety feet North of the intersection
of the East line of Main Street with the North line of
Themis Street and run North with the East line if a
three- story party wall; thence East with said center
line sixty-seven and one-half feet, more or less to a
point half between Main Street and the street on the
Levee; thence South parallel with Main Street twenty-
two feet; thence West parallel with said centerline
sixty-seven and one-half feet to the beginning point
on the East line of Main Street .

All that part of Lot 1, Range E, in the City of Cape
Girardeau, Missouri, fronting 99 feet on Water Street
by 69 feet and 1 inch on Broadway, being the same
property upon which the Riverview Hotel formerly
stood; also all that part of Aquamsi Street described
as follows : Begin at the Southeast comer of Lot 1,
Range E, as established by the Gonner Survey; thence
North along the West line of Aquamsi Street 99 feet;
thence parallel to the North line of Broadway extended
4 feet; thence South parallel to the West along the
North line of Broadway Street extended 4 feet to the
point of beginning.

Twenty feet off the North side of Subdivision Lots
Three and Eleven of Lot one, Block One, Range "C" in
the City of Cape Girardeau, Missouri, particularly
described as follows : Begin at point on the East line
of Main Street seventy feet South of the intersection
of the East line of Main Street with the South line of
Themis Street, which point is the Northwest comer of
said Subdivision lot Eleven of Lot One, Block One,
Range "COO; thence East along the North line of said
Subdivision Lots Eleven and Three one hundred and
thirty five feet, more or less, to the West line of
Water Street, which is the Northeast comer if said
Subdivision Lot Three of Lot One, Block One, Range
"COO; thence South along the West line of Water Street
twenty feet; thence West parallel with Themis Street
one hundred thirty-five feet, more or less, to the
East line of Main Street; thence North along the East
line of Main Street twenty feet to the point of
beginning.

All that part of Lot One, Range "D" in the City of
Cape Girardeau, Missouri, describes as follows :
Commence at the Southwest comer of Lot One, Range "D" ,
and run North along the West line of said Lot One,
forty-eight and sixth-tenths feet for a beginning
point; thence East parallel to the South line of said
Lot One sixty-seven feet; thence North parallel to the
West line of said Lot One forty-three feet; thence
West parallel to the South line of said Lot One to the
West line thereof ; thence South along the West line if
said Lot One to the place of beginning.

All that part of Lot 1, Range E, in the City of Cape
Girardeau, Missouri, describes as follows : From the
Southwest comer of said Lot 1 go Forty-two (42) feet
East along the North Line of Broadway Street for the
point if beginning; thence East Twenty-three (23) feet
along the North line if Broadway street to a point;
thence North parallel to Main Street Ninety-nine (99)
feet to a point; thence West parallel to Broadway
Street Twenty-three (23) feet to a point; thence South
parallel to Main Street Ninety-nine (99) feet to the
point of Beginning .

Part of Lots One and Two (Old Division) of Block One
in Range "C" in the City of Cape Girardeau, Missouri
described by metes and bounds as follows : Starting at
the intersection of the North line of Independence
Street with the East line of Main Street, the same
being the Southwest comer of Lot Two in Range "C" of
said City, and run North along the East line of Main
Street two hundred ten feet for a beginning comer;
thence run East, parallel with Independence Street,
one hundred thirty-four feet to Water Street; thence
South along the West line of Water Street seventy-six
feet; thence West, parallel with Independence Street,
one hundred thirty-four feet to Main Street; and
thence North along the East line of Main Street
seventy six feet to the place of beginning.

Part of Lot Two in Range "C" in the City of Cape
Girardeau describes as follows : Beginning at a point
on the East side of Main Street seventy-eight feet
eleven inches North from the Southwest comer of said
lot; thence running East to Water Street parallel with
Independence Street one hundred thirty-four feet;
thence with Water Street North fifty-five feet; thence
West parallel with Independence Street one hundred
thirty-four feet to Main Street; thence South with
Main Street to the point of beginning.
ARTICLE 2 . This ordinance shall be in full force and
effect ten days after its passage and approval .
