AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 824
SOUTH KINGSHIGHWAY, IN THE CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI FROM M-2 to C-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from M-2 , Heavy Industrial District, to C-2 ,
General Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, June 2, 2008 , and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from M-2 , Heavy Industrial District, to C-2 , General
Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present M-2, Heavy Industrial District, to
C-2, General Commercial District, for the following described
property:
THAT PART OF FRACTIONAL SECTION 12 AND PART OF UNITED
STATES PRIVATE SURVEY NO. 222 ALL IN TOWNSHIP 30
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN
IN THE CITY AND COUNTY OF CAPE GIRARDEAU, THE STATE OF
MISSOURI, DESCRIBED AS FOLLOWS:
Commence at the northeast corner of said Fractional
Section 12 ; thence South 07013149" West, with the east
line of said Fractional Section 12 , a distance of
1083 . 50 feet, to a found stone at the southeast corner
of R & M Subdivision, as recorded in Plat Book 12 at
page 24 of the Land Records of said Cape Girardeau
County, the point of beginning; thence North 88030 ' 00"
West, with the south line of said subdivision and said

line extended, a distance of 806 . 08 feet, to a point
on the east right of way line of South Kingshighway;
thence with said right of way line, South 0300814811
West, 347 . 15 feet, to the northwest corner of a tract
described in Deed Book 442 , at page 196 of the land
records of said Cape Girardeau County; thence with the
north line of said tract, and said line extended South
8900210211 East, 782 . 00 feet, to the northeast corner
of a tract described in Deed Book 427 at page 223 of
the land records of said Cape Girardeau County; thence
North 0701314911 East, 341 . 42 feet, to the point of
beginning, and containing 6 . 26 acres, more or less, as
shown on the accompanying plat . Subject to any
easements of record.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of a C-2,
General Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect. ten days after its passage and approval .
