AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 265
NOTRE DAME DRIVE, IN THE CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 to R-4
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-1, Single-Family Dwelling District, to
R-4 , Multi-Family Dwelling District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, June 2 , 2008, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-1, Single-Family Dwelling District, to R-4 ,
Multi-Family Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present R-1, Single-Family Dwelling
District, to R-4 , Multi-Family Dwelling District, for the
following described property:
ALL THAT PART OF FRACTIONAL SECTION 4 , TOWNSHIP 30
NORTH, RANGE 13 EAST OF THE FIFTH PRINCIPAL MERIDIAN,
IN THE COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI,
MORE PARTICULARLY DESCRIBED AS FOLLOWS :
COMMENCE at the Southeast Corner of United States
Private Survey No. 218 , thence North 150 16 ' 51" East,
734 . 57 feet to the place of beginning; thence North
890 29' 16" East, 1375 . 16 feet; thence South 000 30'
44" East, 396 . 41, thence South 89° 29' 16" West,
1, 375 . 16 feet, thence North 00030' 44" West, 396 .41
feet, to the place of beginning and containing 12 . 51
acres, more or less .

Article 2, The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-4 ,
Multi-Family Dwelling District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
