AN ORDINANCE AUTHORIZING ACCEPTANCE OF FEE SIMPLE
INTEREST, PERMANENT EASEMENTS, AND TEMPORARY
CONSTRUCTION EASEMENTS FROM NORWALD, INC. AND
i`IEYR PROPERTIES, L.P. FOR THE CONSTRUCTION OF LASALLE
AVENUE,AND OTHER ACTIONS RELATING TO THE PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau,Missouri hereby accepts a Permanent Drainage Easement
executed by Norwald, Inc.,convetiing an easement to the City of Cape Girardeau, 1-Gssouri for the
construction of LaSalle Avenue, more particularly described as follows, to-wit-.
All of that part of Fractional Secuon 3,Township 31 North,Range 13 East of the Fifth Principal
Meridian,Cape Girardeau Countv, ivfissouri, described as follows:
From the Southeast corner of said Section 3 measure S 88°58'XV along the south line thereof a
distance of 1308.0 feet, thence, departing said south line N 71°57'W a distance of 624.7 feet to the
point of beginning; thence, continue N 71'57'\K7 a distance of 30.1 feet, thence,S 23'16'W a
distance of 18.2 feet, thence, S 66°44'E a distance of 30.0 feet; thence, Nt 23°16' E a distance of 20.9

ARTICLE 9. The City staff again is authorized and directed to acquire the property needed for the
construction of LaSalle Avenue between I-» and State Route W in Cape Girardeau County. The Cine staff is
hereby authorized and directed to accept offers of donation of property needed,make appropriate offers of
purchase to the owners of the properties based on values provided by professional appraisers; to negotiate
with the owners of the property in an effort to reach agreement for the purchase of the property needed and
if the negotiations fail, then to proceed to acquire the needed properties through the exercise of the City's
powers of Em hent Domain. Notwithstanding any other provisions of the City Code, the City Council
hereby authonzes all of the above actions heretofore taken by City staff and all expenditures for this project
from the Transportation Trust Fund,within the full range of authority granted by Section 94.700 et seq. of
the Revised Statutes of Missouri and all other applicable law.
ARTICLE 10. This ordinance shall be in full force and effect ten days after its passage and approval.
