AN ORDINANCE AMENDING SECTION 26-262 OF THE
CITY CODE RELATING TO PARKING VIOLATION
PENALTIES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS :
ARTICLE 1. Section 26-262 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, reading as follows :
Sec. 26-262 . Penalties .
(a) Any person accused of violating section 26-248,
26-249 or 26-257 , upon conviction or upon
entering a plea of guilty, shall pay a fine
according to the following schedule:
(1) Ten dollars ($10 . 00) if paid within seven
(7) days following the violation.
(2) Fifteen dollars ($15 . 00) if paid more than
seven (7) days but within thirty (30) days
following the violation.
(3) Twenty-five dollars ($25 . 00) if paid more
than thirty (30) days following the
violation.
(b) Any person accused of violating section 26-246,
26-247 , 26-250, 26-251, 26-252, 26-253, 26-255,
26-256, 26-258 , 26-259, or 26-261, upon
conviction or upon entering a plea of guilty,
shall pay a fine according to the following
schedule:
(1) Fifteen dollars ($15 . 00) if paid within
seven days following the violation.
(2) Twenty-five dollars ($25 . 00) if paid more
than seven (7) days following the violation.
(c) Any person accused of violating section 26-260
upon conviction or upon entering a plea of

guilty, shall pay a fine according to the
following schedule :
(1) Fifty dollars ($50 . 00) if paid within seven
(7) days following the violation.
(2) Not more than two hundred dollars ($200 . 00)
if paid more than seven (7) days following
the violation.
is hereby repealed in its entirety, and a new Section 26-262 is
hereby enacted in lieu thereof, in words and figures, to read as
follows :
Sec. 26-262 . Penalties .
(a) Any person accused of violating section 26-246,
26-247 , 26-248, 26-249, 26-250, 26-251, 26-252,
26-253 , 26-255, 26-256, 26-257, 26-258, .26-259 or
26-261, upon conviction or upon entering a plea
of guilty, shall pay a fine according to the
following schedule:
(1) Twenty-five dollars ($25 . 00) if paid within
seven (7) days following the violation.
(2) Thirty-five dollars ($35 . 00) if paid more
than seven (7) days but within thirty (30)
days following the violation.
(3) Forty-five dollars ($45 . 00) if paid more
than thirty (30) days following the
violation.
(b) Any person accused of violating section 26-260
upon conviction or upon entering a plea of
guilty, shall pay a fine according to the
following schedule:
(1) Fifty dollars ($50 . 00) if paid within seven
(7) days following the violation.
(2) Not more than two hundred dollars ($200 . 00)
if paid more than seven (7) days following
the violation.
ARTICLE 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent

jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof .
ARTICLE 3. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may
be renumbered to accomplish such intention.
ARTICLE 4. This ordinance shall be in full force and effect
ten days after its passage and approval .
