AN ORDINANCE ACCEPTING A GENERAL WARRANTY
DEED FROM CLAUDE AND DOROTHY FOESTE FOR
THE REALIGNMENT OF LOMBARDO DRIVE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, il5ssouri hereby accepts fee simple interest granted by
Claude and Dorothy Foeste, conveying property to the City of Cape Girardeau, Missouri for the realignment
of Lombardo Drive, more particularly described as follows, to-wit:
PART OUT LOT 73 IN SURVEY 2199,TO\CNSHIP 31 NORTH,RANGE 13 EAST THE CITY
OF CAPE GIRARDEAU IN CAPE GIRARDEAU COUNTY, MISSOURI CONTAINING 4
SQUARE FEET(MORE OR LESS), DESCRIBED AS FOLLOWS: COMMENCE at the
southeast comer of Out Lot 75, Survey 2199,Township 31 North, Range 13 East(nothing found--
position per Landgrafs Third Subdivision in the City of Cape Girardeau as shown in Plat Book 06,
Page 14); thence N 82030'00" W along the South Line of said Out Lot 73, 997.80 feet to the
southeast comer of said Landgrafs Third Subdivision; thence N 49000'00" E along the East Line of
said Subdivision, 55.00 feet; thence N 13020'00" E along the East Line of said Subdivision, 225.00
feet; thence N 20030'00" E along the East Line of said Subdivision, 208.00 feet; thence N 09016'00"
E along the East Line of said Subdivision and with said East Line extended, 325.03 feet to a point in
the North Right of Way Line of Lombardo Drive; thence S 82048'00" E along said Right of Way
Line, 51.24 feet to the Point of Tangent of a Curve to the Leh having a Radius of 175.00 feet for the
POINT OF BEGINNING: thence southeasterly along the arc of said Curve to the Left, 11.14 feet
(Chord = S 87010'15' E, 11.14 feet) to a point on the West Right of Way Line of Walker Street now
vacated; thence S 07012'00"N along said West Right of Way Line, 0.85 feet to a point in the existing
North Right of Way Line of Lombardo Drive; thence N 82%%48'00"W along said Right of Way
Line, 11.10 feet to the POINT OF BEGINNING.
PART OF OUT LOT 75 IN SURVEY 2199,TOWNSHIP 31 NORTH,RANGE 13 FAST THE
CITY OF CAPE GIRARDEAU IN CAPE GIRARDEAU COUNTY, MISSOURI
CONTAINING 563 SQUARE FEET (MORE OR LESS),DESCRIBED AS FOLLOWS:
COTN4MENCE at the southeast comer of Out Lot 75, Survey 2199,Township 31 North,Range 13
East (nothing found--position per Landgrafs Third Subdivision in the City of Cape Girardeau as
shown in Plat Book 06, Page 14); thence N 82030'00" W along the South Line of said Out Lot 75,
997.80 feet to the southeast comer of said Landgrafs Third Subdivision; thence N 49000'00" E
along the East Line of said Subdivision, 55.00 feet; thence N 13020'00" E along the East Line of said
Subdivision, 225.00 feet, thence N 20030'00" E along the East Line of said Subdivision, 208.00 feet;
thence N 09016'00" E along the East Line of said Subdivision, 275.00 feet to a point in the South
Right of Nay Line of Lombardo Drive, said point being the northeast comer of said Subdivision;

the Left having a Radius of 175.00 feet; thence northeasterly along the arc of said Curve to the Left,
61.18 feet(Chord = N 87009'48" E, 60.99 feet) to a point on the East Right of Way Line of'Nalker
Street now vacated for the POINT OF BEGINNING; thence N 07012'00" E along said East Right
of Way Line, 16.47 feet; thence S 831113'00" E, 97.41 feet to a point in the existing South Right of
Wav Line of Lombardo Drive; thence N 8802213" \\1, 50.16 feet to the Point of Tangent of a Curve
to the Left having Radius of 175.00 feet; thence southwesterly along the arc of said Curve to the

Left,40.18 feet(Chord = S 83039'36"W,40.09 feet) to the PRC of a Curve to the Right having a
Radius of 225.00 feet; thence southwesterly along the arc of said Curve to the Right,8.99 feet
(Chord = S 78013'42" W, 8.99 feet) to the POINT OF BEGINNING.
ARTICLE 2. This ordinance shall be in full force and effect ten days after its passage and approval.
