AN ORDINANCE AUTHORIZING THE ACQUISITION OF
PROPERTY FOR WATER SYSTEM IMPROVEMENTS
ADJACENT TO WATER PLANT NO. 2
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI,AS FOLLOWS:
ARTICLE 1. The City Staff is authorized and directed to acquire certain property needed
for ingress/egress, the drilling of water wells, the extraction of water,and the installation of public
water transmission lines adjacent to Water Plant No. 2. The City staff is hereby authorized and
directed to accept offers of donation of property needed, make appropriate offers of purchase to
the owners of the properties based on values provided by professional appraisers; to negotiate with
the owners of the property in an effort to reach agreement for the purchase of the property needed
and if the negotiations fail, then to proceed to acquire the needed properties through the exercise of
the City's powers of Eminent Domain. All of the above actions heretofore taken by City-Staff
relating to the following tracts are hereby authorized and ratified by the City Council.
ARTICLE 2. The property designated for acquisition for this project are as follows:

Part of U.S. Private Survey No 2202,Township 30 North, Range 13 and 14 East, part of
Sections 18 and 19,Township 30 North, Range 14 East,part of U.S. Private Survey No. 812
and No. 2919, and part of Section 13 and 24,Township 30 North,Range 13 East, County
of Cape Girardeau,State of Missouri described as follows:
Start at the center of Section 19,Township 30 North,Range 14 East; thence S 88°03'W
along the east-west quarter section line of said Section 19 and the east-west quarter section
line of Section 24,Township 30 North, Range 13 East,3,960 feet to the northeast corner of
the west half of the southeast quarter of said Section 24; thence S 1°57'E, on the east line
of said west half, 2,640.0 feet to the south line of said Section 24 on the north line of Little
River Drainage District Ditch No. 2; thence S 88°0310; on the south line of Section 24,
1013.75 feet to the point of beginning; thence continue S 88°03'\V",on the south line of
Section 24, 239.75 feet to the center of the old Rock Levee Road; thence N 35025VI,with
said Road 260.1 feet; thence N 31°51'\\, with said Road 4684.2 feet to the south line of the
St. Louis and San Francisco Railroad; thence N 63°24'E, with said south line, 200.84 feet;
thence S 31'51'E,parallel and 200 feet east of the centerline of old Rock Levee Road,
4659.60 feet; thence S 35°25' E,parallel and 200 feet east of the centerline of old Rock
Levee Road, 386.08 feet to the point of beginning and containing 22.93 acres, more or less.
ARTICLE 3. The Council of the City of Cape Girardeau,Missouri, hereby fords and
declares that the acquisition of the above described properties is for a public use and that such
acquisition is within the scope of the authority or power of the City-of Cape Girardeau,Missouri,
and that the acquisition of the properties is reasonable and necessary for public use in order to
provide for public water system improvements.
ARTICLE 4. This ordinance shall be in full force and effect ten days after its passage and
approval.
