AN ORDINANCE AUTHORIZING THE MAYOR TO
EXECUTE A GENERAL WARRANTY DEED FOR TWO (2)
TRACTS OF LAND, INCLUDING A GROUND-LEVEL
WATER STORAGE TANK, PUMP HOUSE, AND
APPURTENANCES, ALONG WITH AN ACCESS AND
UTILITY EASEMENT, TO RHODES DEVELOPMENT
COMPANY, L. L. C.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The Mayor, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute a
General Warranty Deed for two (2) tracts of land, including a
ground-level water storage tank, pump house, and appurtenances,
along with an Access and Utility Easement, to Rhodes Development
Company, L.L.C. , said real property located in the City of Cape
Girardeau, Missouri more particularly described as follows :
Beginning at a point on the South line of Outlot 61,
South 820 37' 04" East, 2193 . 56 feet from the
Southwest Corner of Outlot 61; thence North 020 06'
36" West, 60 . 00 feet; thence South 820 37' 04" East,
60 . 00 feet; thence South 020 06' 36" East, 60 . 00 feet;
thence North 820 37' 04" West, 60 . 00 feet to the point
of beginning, containing 0 . 08 acres, more or less.
ALSO, commencing at a point on the South line of
Outlot 61, South 820 37' 04" East, 2193 . 56 feet from
the Southwest corner of Outlot 61; thence North 020
06' 36" West 100 feet to a point of beginning; thence
South 82° 37 ' 04" East, 100 feet; thence South 02°
06' 36" East, 100 feet; thence North 820 37' 04" West,
40 feet; thence North 020 06' 36" West, 60 feet;
thence North, 820 36' 04" West, 60 feet; thence North
020 06' 36" West, 40 feet to the point of beginning,
containing 0. 15 acres, more or less . (Descriptions
from deeds recorded in Book 498 , Page 24 and Book 509,
Page 31, land records of Cape Girardeau County,
Missouri) . ALSO, a one hundred fifty thousand
(150, 000) gallon ground-level water storage tank, pump
house, water lines and necessary appurtenances on the
above-described tracts to furnish a sufficient water
supply to operate a fire sprinkler system for the
Rhodes Development Company, L.L. C. , company building
immediately northwest of the tank site (formerly owned
by Spicer Manufacturing, Inc . ) and described by deed
recorded as Document No. 2007-17973 in the land
records of Cape Girardeau County, Missouri .
TOGETHER WITH AN EXCLUSIVE EASEMENT for access and
utility purposes over and across the following
described property: Starting at the Southwest corner
of Outlot 61; thence South 820 37' 04" East, 2193 . 56
feet along the south line of Outlot 61; thence North
020 06' 36" West, 60 . 00 feet to the point of
beginning; thence North 020 06' 36" West, 746 . 51 feet
to the South line of Corporate Circle Drive; thence
North 870 53 ' 24" East, 15 . 00 feet along the South
line of Corporate Circle Drive; thence South 020 06'
36 : East, 749 . 02 feet; thence North 820 37' 04" West,
15 . 21 feet to the point of beginning, containing 0 .26
acres, more or less, pursuant to that certain Access
and Utility Easement recorded in Book 498 , Page 26,
land records of Cape Girardeau County, Missouri .
The water line on the above-described easement shall
begin on the service side of the shut-off valve on the
main City water line located within the Corporate
Circle right-of-way.
ARTICLE 2 . This ordinance will be in full force and effect
ten days after its passage and approval .
