AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU
REGARDING ADDITIONAL COURT COSTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1. That there is hereby enacted a new Section 16 . 33,
Chapter 16 of the Code of Ordinances of the City of Cape
Girardeau, Missouri, entitled "Additional court costs - Two
dollar surcharge" , to read as follows :
Section 16 . 33 Additional court costs - two dollar
surcharge.
(a) In addition to all other court costs authorized
by state statute or by the City Code of Cape
Girardeau, Missouri, the official of the
municipal court responsible for collecting court
costs and fines shall assess as court costs two
additional dollars ($2 . 00) for each court
proceeding filed for violation of the ordinances
of the city; except that no such fee shall be
collected in any proceeding in the court when the
proceeding or the defendant has been dismissed by
the court or when costs are to be paid by the
city.
(b) Notwithstanding any other provision of law, the
moneys collected by clerks of the courts pursuant
to the provisions of subsection (a) of this
section shall be collected and disbursed in
accordance with sections 488 . 010 to 488 . 020, and
shall be payable to the court clerk.
(c) The court clerk shall deposit funds generated by
the surcharge into the "Inmate Security Fund" .
Funds deposited shall be utilized to develop
biometric verification systems to ensure that
inmates can be properly identified and tracked
within the city jail system. Upon the
installation of the biometric verification
system, funds in the inmate security fund may be
used for the maintenance of the biometric

verification system, and to pay for any expenses
related to custody and housing and other expenses
for prisoners .
ARTICLE 2 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof .
ARTICLE 3 . It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and the sections of this Code
may be renumbered to accomplish such intention.
ARTICLE 4 . This ordinance shall be in full force and
effect ten days after its passage and approval . �p
