AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A
QUIT CLAIM DEED FOR A SECTION OF A RAIL SPUR IN
THE NASH ROAD INDUSTRIAL PARK TO BIOKYOWA, INC. ,
IN THE COUNTY OF CAPE GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . The Mayor, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute a Quit
Claim Deed for a section of a rail spur in the Nash Road
Industrial Park to Biokyowa, Inc . , said real property located in
the County of Cape Girardeau, Missouri more particularly
described as follows :
A 100-foot-wide permanent easement for construction
and maintenance of a rail spur granted to the City of
Cape Girardeau by the Greater Cape Girardeau
Benevolent Association, and any temporary easements
associated with the same that may still be in effect
as of this date, from a point located on the
centerline of the rail spur tracks 2, 080 feet south of
the south right-of-way line of Missouri Route AB,
a/k/a Nash Road; thence South; thence with a curve to
the west; thence west; thence with a curve to the
north; thence north to the end of the described
permanent easement .
All railroad tracks, a side spur, cross ties, rail
bed, drainage facilities, and any and all ancillary
facilities located upon the above-described permanent
easement .
ARTICLE 2 . This ordinance will be in full force and effect
ten days after its passage and approval . �g

THIS INDENTURE, Made on the day of M0141 A.D. Two Thousand and Nine
by and between the City of Cape Girardeau, a Municipal dorporation, of the County of Cape
Girardeau and State •of. Missouri, party of the First Part, and Biokyowa, Inc., a Missouri
Corporation, of the County. of Cape Girardeau and State of Missouri, party of the Second Part.
WITNESSETH, That the said party of the First Part in consideration of the sum of Ten
Dollars ($10.00) and other ,good and valuable consideration, to it paid by the said party of the
Second Part, the receipt of which is hereby acknowledged, does by these presents, Remise,
Release and forever Quit Claim, unto said party of the Second Part, the following described
property, lying, being and situate in the County of Cape. Girardeau and State of Missouri, to -wit:

TO HAVE AND TO HOLD THE SAME, with all the rights, immunities, privileges and
appurtenances thereto belonging, unto the said party of the Second Part, and its successors and
assigns, FOREVER, so that neither the said party of the First Part, nor its successors or assigns,
or any other person or persons for it or in its name or behalf, shall or will hereafter claim or
demand any right or title to the aforesaid premises or any part thereof, but they and every one of
them shall, by these presents, be excluded- and forever barred.
IN WITNESS WHEREOF, the said party of the First Part has hereunto set its hand the
day and year first above written.
