HomeMy WebLinkAboutOrd.4022.05-04-2009 BILL NO. 09 - 68 ORDINANCE No. D1ROg AN ORDINANCE AUTHORIZING THE ACQUISITION OF PROPERTY FOR THE BEND ROAD — MASON STREET—MAIN STREET IMPROVEMENT PROJECT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,AS FOLLOWS: ARTICLE 1. The City Staff is authorized and directed to acquire certain property needed for the improvement of Bend Road—Mason Street—Main Street between Mill Street and East Cape Rock Drive. The City staff is hereby authorized and directed to accept offers of donation of property needed, make appropriate offers of purchase to the owners of the properties based on values provided by professional appraisers; to negotiate with the owners of the property in an effort to reach agreement for the purchase of the property needed and if the negotiations fail, then to proceed to acquire the needed properties through the exercise of the City's powers of Eminent Domain. All of the above actions heretofore taken by City Staff relating to the following tracts are hereby authorized and ratified by the City Council. ARTICLE 2. The property designated for acquisition for this project are as follows: TRACT 1. REBA ABBOTT TEMPORARY CONSTRUCTION EASEMENT All the grantor's land lying in part of Section 32,Township 31 North, Range 14 East of the Fifth Principal Meridian, City and County of Cape Girardeau, State of Missouri, being more particularly described as follows: Commence at the northwest comer of a tract of land as recorded in Book 1045 at Page 130 of the land records of the Cape Girardeau County Recorder's Office, also known as the East 1/3 of the West 113 feet of Lot 54, Range O of Ingram's Addition as platted in Plat Book 1 at Page 6 of the Cape Girardeau County Recorder's Office; thence along the south right of way line of Mason Street, South 83° 54' 59" East, 37.66 feet to the northeast comer of said tract; thence leaving the south right of way line of Mason Street along the east line of said tract, South 05° 47' 00"West, 2.00 feet; thence leaving said east line, North 83° 54' 59" West, 21.26 feet to a point; thence South 06° 59' 35"West, 1.00 feet to a point; thence North 83° 54' 59"West, 16.39 feet to a point on the west line of said tract; thence along said west line, North 06° 05' 01" East, 3.00 feet to the point of beginning.
