AN ORDINANCE ACCEPTING FEE SIMPLE INTEREST AND
TEMPORARY CONSTRUCTION EASEMENTS FROM VARIOUS PROPERTY
OWNERS FOR THE FOUNTAIN STREET II IMPROVEMENTS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau,Missouri hereby accepts fee simple interest executed by
CLILA,LP, conveying property to the City-of Cape Girardeau,Missouri for the Fountain Street II
improvements,more particularly-described as follows, to-wit:
All that part of the West one-third (1/3) of Lot No. Twenty=-nine (29) in Range "H"in the City of
Cape Girardeau,Missouri, described as follows: From a point marking the Southwest corner of said
Lot 29, and the Point of Beginning, measure S83'51'E a distance of 59.90 feet, to a '/z"re-bar;
thence,N06°10'E a distance of 51.8 feet, to a point; thence,N45'51'W a distance of 122 feet, to a
point; thence,N14°33'W a distance of 36.90 feet, more or less, to a point on the North line of said
Lot 29; thence,N83°47'W along the north line thereof, a distance of 30.00 feet, to a point marking
the northwest corner thereof, thence, S06°06'W along the west line of said Lot 29,a distance of
112.4 feet, more or less, to the Point of Beginning, containing 0.129 acres, more or less.
And Also
All of that part of Lot 33 of Range"H"in the City of Cape Girardeau, Cape Girardeau County,
Missouri,described as follows:From the Northeast corner of said lot 33 and the Point of
Beginning measure N 83'48'W along the southerly right-of-way line of Good Hope Street a
distance of 44.1 feet; thence,S 06°10'W a distance of 5.6 feet; thence, S 83°29'E a distance of 34.1
feet; thence,S 71°38'E a distance of 10.2 feet to the existing Westerly right-of-way line of Fountain
Street; thence,N 06°05'E along said right-of-way line a distance of 8.0 feet to the Point of
Beginning and containing 0.01 acre (264 square feet), said acreage being subject to easements and
rights-of-way.
And Also
All of that part of Lot 36 of Range "H"in the City of Cape Girardeau, Cape Girardeau County,
Missouri, described as follows: From the Southeast corner of said lot 36 and the Point of
Beginning measure N 06'05'E along the existing Westerly right-of-way line of Fountain Street a
distance of 17.1 feet; thence, S 67°02'W a distance of 35.0 feet to the Northerly right-of-way line of
Morgan Oak Street; thence, S 83°43'E along said right-of-way line a distance of 30.6 feet to the
Point of Beginning and containing 0.01 acre (260 square feet), said acreage being subject to
easements and rights-of-way.
ARTICLE 2. The City of Cape Girardeau,Missouri hereby accepts a Temporary Construction
Easement executed by CLILA,LP, conveying an easement to the City of Cape Girardeau,Missouri for the
Fountain Street II improvements,more particularly described as follows, to-wit:
All of that part of Lots 33, 34, 35, and 36 of Range "H"in the City of Cape Girardeau, Cape
Girardeau County,Missouri, described as follows:
From the Southeast corner of said lot 36 measure N 06'05'E along the Westerly right-of-way line of
Fountain Street a distance of 17.1 feet to the Point of Beginning of a temporary construction
easement; thence, continue N06°05'E along said right-of--way line a distance of 11.4 feet; thence, S

67°02'W a distance of 58.4 feet to the Northerly right-of-way of Morgan Oak Street; thence, S
83'43'E along said right-of-way line a distance of 20.E feet; thence,N 67002'E a distance of 35.0
feet to the Point of Beginning with the above described easement containing 0.01 acre (464 square
feet).
And Also
From the Northeast corner of Lot 33 measure S 06'05'W along the existing Westerly right-of-way
line of Fountain Street a distance of 5.8 feet to the Point of Beginning of a temporary construction
easement said easement being a strip of land, 10.0 feet in width, coincident to, adjoining with and
lying on the Westerly side of the following described line; thence,S 06'05'W along the existing
Westerly right-of-way line of Fountain Street a distance of 331.E feet to the North line of Lot 36 and
there terminating with the area of the above described easement being 0.08 acre.
And Also
A temporary construction easement across a part of the West forty (40.0) feet of the East eighty
(80.0) feet of Lot No. Twenty-nine (29) in Range "H"in the City of Cape Girardeau,Missouri,
described as follows:
from a point marking the Southeast corner of said Lot 29, measure N83°46'W a distance of 40.0
feet, to a '/z"re-bar and the Point of Beginning; thence,ND-9'42'W a distance of 34.9 feet, to a point;
thence,N4:-)°:-)1'W a distance of 10.D-0 feet, to a point; thence,N06'1 6'E a distance of 12.7 feet, to a
point; thence,S45°:-)1'E a distance of 17.1 feet, to a point; thence, S59°42'E a distance of 29.2 feet, to
a point; thence,S06'1 VW a distance of.11.0 feet, to the Point of Beginning, containing 0.011 acres,
more or less.
And Also
All that part of Lot No. twenty-nine (29) in Range "H"in the City of Cape Girardeau, Missouri,

a distance of 59.90 feet, to a '/2"re-bar; thence S83°35'E a distance of 39.9 feet, to a '/z"re-bar;
thence,N06°16'E a distance of 20.7 feet, to the Point of Beginning; thence,N45'51"W a distance of

ARTICLE 3. The City of Cape Girardeau, Missouri hereby accepts fee simple interest executed by
Michael Pryor, conveying property to the City of Cape Girardeau,Missouri for the Fountain Street II
improvements, more particularly described as follows, to-wit:
All of that part of Lot 36 of Range"G"in the City of Cape Girardeau, Cape Girardeau County,
Missouri, described as follows:

From the Southeast corner of said lot 36 and the Point of Beginning measure N 06°11'E along the
existing Westerly right-of-way line of Fountain Street a distance of 8.0 feet; thence,S 83°02'W a
distance of 9.0 feet; thence,N 84004'W a distance of 35.1 feet; thence, S 06°31'W a distance of 6.0
feet to the Northerly right-of-way of Good Hope Street; thence, S 84°03'E along said right-of-way
line a distance of 43.9 feet to the Point of Beginning and containing 0.01 acre (271 square feet).
ARTICLE 4. The City of Cape Girardeau, Missouri hereby accepts a Temporary Construction
Easement executed by Michael Pryor, conveying an easement to the City of Cape Girardeau, Missouri for the
Fountain Street II improvements, more particularly described as follows, to-wit:
All of that part of Lot 36 of Range "G"in the City of Cape Girardeau, Cape Girardeau County,
Missouri, described as follows:
From the Northeast corner of said lot 36 and the Point of Beginning of a temporary construction
easement measure N 84'09'W along the North line of said lot 36 a distance of 8.4 feet; thence,
departing said North line S 04°13'E a distance of 46.1 feet to the existing Westerly right-of-way line
of Fountain Street; thence,N 06°11'E along said right-of-way line a distance of 45.4 feet to the
Point of Beginning with the area of the above described easement being 0.01 acre (187 square feet).
ARTICLE 5. The City of Cape Girardeau, Missouri hereby accepts a Temporary Construction
Easement executed by Southeast Missouri State University, conveying an easement to the City of Cape
Girardeau, Missouri for the Fountain Street II improvements, more particularly described as follows, to-wit:
All of that part of Lot 26 of Range "I"in the City of Cape Girardeau, Cape Girardeau County,
Missouri, described as follows:
From the Northwest corner of said lot 26 measure S 06'14'W a distance of 20.0 feet to the existing
Northerly right-of-way line of Morgan Oak Street; thence, S 83'40'E along said right-of-way line a
distance of 170.E feet to the Point of Beginning of a temporary construction easement; said
easement being a strip of land, 10.0 feet in width, coincident to, adjoining with and lying on the
Southerly and Easterly side of the following described line; thence, along a curve to-the left having a
radius of 90.0 feet, a Chord length of 127.2 feet,and a Chord bearing of S 48'53'W, and arc distance
of 141.3 feet to a point on the existing Easterly right-of-way line of Fountain Street and there
terminating with the area of above described easement being 0.03 acre.
ARTICLE 6. This ordinance shall be in full force and effects ten days after its passage and approval.
