AN ORDINANCE AUTHORIZING ACCEPTANCE OF TEMPORARY
CONSTRUCTION EASEMENTS FROM: JOSEPH R. AND IQMBERLY M.
BAKER, S&H APARTMENTS LLC, KERMAT ENTERPRISES LLC, AND
ELITE DEVELOPMENT LLC, FOR THE LISA STREET DETENTION
BASIN MODIFICATIONS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri hereby accepts donation of a temporary
construction easement executed by Joseph R. Baker and Kimberly M. Baker, husband and wife, conveying
use of property to the City of Cape Girardeau, Missouri for the Lisa Street Detention Basin Modifications,
more particularly described as follows, to-wit:
A temporary construction easement in the East ten (10) feet of the West 105 feet of Lot 2 of
Melrose Place 1II, an addition to the City of Cape Girardeau, Missouri, as shown in Plat Book 19 on
Page 52 of the Cape Girardeau County Land Records. The street address of the property is 1929
Randol Ave.
ARTICLE 2. The City of Cape Girardeau, Missouri hereby accepts donation of a temporary
construction easement executed by Steve Essner, for S&H Apartments, LLC, conveying use of property to
the City of Cape Girardeau, Missouri for the Lisa Street Detention Basin lAodifications, more particularly
described as follows, to-wit:
A temporary construction easement in Lot 62 of Greenwood Second Subdivision, in the City= of
Cape Girardeau, Missouri, as shown in Plat Book 13 on Page 21 of the Cape Girardeau County Land
Records; said easement described as follows: From a point marking the Southeast corner of said Lot
62, measure N 88° 30'W along the South line thereof a distance of 20.00 feet, to a point on the West
line of an existing 20.00 feet easement, for the point of beginning; thence, N 00° 01'00" E along the
West line of said existing 20.00 feet easement, a distance of 107.54 feet, to a point on the South line
of an existing 12.50 feet easement; thence N 88° 30' 00" W along the South line of said existing
12.50 feet easement, a distance of 45.90 feet, to a point; thence, S 75° 30' 00" E a distance of 39.60
feet, to a point; thence, S 0° 20' 46" E a distance of 66.02 feet, to a point; thence S 36° 30' 00" W a
distance of 39.80 feet, to a point on the South line of said Lot 62; thence, S 88° 30' E a distance of
30.80 feet, to the point of beginning. The street address of the property is 2560 Lisa Dr.
ARTICLE 3. The City of Cape Girardeau, Missouri hereby accepts donation of a temporary
construction easement executed by Robert J. Basler, general partner for Kermat Enterprises, LLC, conveying
use of property to the City of Cape Girardeau, Missouri for the Lisa Street Detention Basin Modifications,
more particularly described as follows, to-wit:
A temporary construction easement in Lot 64 of Greenwood Second Subdivision, in the City of
Cape Girardeau, Missouri, as shown in Plat Book 13 on Page 21 of the Cape Girardeau County Land
Records; said easement described as follows: From a point marking the Southeast corner of said Lot
64; measure N 88° 30' W along the South line thereof a distance of 20.0 feet, to a point on the West
line of an existing 20.00 feet easement; thence, N 0° 01' 00" E along the West line of said existing
20.00 feet easement a distance of 7.50 feet, to a point on the North line of an existing 7.50 feet
easement, for the point of beginning; thence N 0° 01' 00" E continuing along the West line of said
existing 20.00 feet easement, a distance of 30.50 feet, to a point; thence, S 31° 01' W a distance of

12.10 feet, to a point; thence, S 61° 14' 01" W a distance of 22.54 feet, to a point; thence N 88° 30'
00" W a distance of 19.20 feet, to a point; thence S 0° 01' 00"W a distance of 8.6 feet, to a point on
the North line of said existing 7.5 feet easement; thence, S 88° 30' 00" E along said North line of
said existing 7.5 feet easement, a distance of 45.20 feet, to the point of beginning. The street address
of the property is 1928 Delwin St.
ARTICLE 4. The City of Cape Girardeau, Missouri hereby accepts donation of a temporary
construction easement executed by Bruce Baker, owner of Elite Development, LLC, conveying use of
property to the City of Cape Girardeau, Missouri for the Lisa Street Detention Basin Modifications, more
particularly described as follows, to-wit.
A temporary construction easement in the East ten (10) feet of the West 105 feet of Lot 1 of
Melrose Place III, an Addition to the City of Cape Girardeau, Missouri, as shown in Plat Book 19 on
Page 52 of the Cape Girardeau County Land Records. The street address of the property 1s1925
Randol Ave.
ARTICLE 5. The Council of the City of Cape Girardeau, Missouri, hereby finds and declares that
the acquisition of the above described properties is for a public use and that such acquisition is within the
scope of the authority or power of the City of Cape Girardeau, Missouri, and that the acquisition of the
property is reasonable and necessary for public use in order to provide for the Lisa Street Detention Basin
Modifications Project.
ARTICLE 6. This ordinance shall be in�jfull force and effect ten days after its passage and approval.
