AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF 401,
409, 413 , 419 AND 421 NORTH STREET, 323 , 329
AND 333 NORTH FOUNTAIN STREET AND 318 , 326,
330, 332 AND 338 NORTH MIDDLE STREET, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI
FROM R-4 TO RUMD
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-4 , Medium Density Multifamily
Residential District, to RUMD, Residential Urban Mixed Density
District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, November 1, 2010; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-4 , Medium Density Multifamily Residential
District, to RUMD, Residential Urban Mixed Density District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning of 401, 409, 413 , 419 and 421 North Street, 323 , 329
and 333 North Fountain Street and 318 , 326 , 330 , 332 and 338
North Middle Street, from R-4 , Medium Density Multifamily
Residential District, to RUMD, Residential Urban Mixed Density
District, said area including the following described property:
Tract 1
All of the East 90 feet of the North 106 feet of Lot
Fourteen (14) in Range "F" in the City of Cape
Girardeau, Missouri .

Tract 2
The East Half of the West Half of Lot No. 14 in Range
"F" in the City of Cape Girardeau, being 45 feet front
on North Street, by a depth of 105 % feet, being the
same realty described in Trustee' s Deed dated April
10, 1987 - Book 64 page 494 .
Tract 3
Part of Lot Fourteen (14) in Range "F" in the City of
Cape Girardeau, Missouri, described as follows :
Beginning at the Northwest corner of said Lot No. 14
in Range "F" thence East with the South line of North
Street 45 feet to a corner, thence South parallel with
Fountain Street, 105 . 75 feet to a corner on the North
side of a ten (10) foot alley; thence West with the
North line of said alley, 45 feet to the East side of
an alley 16 . 25 feet wide, and thence North, along the
East side of said 16 . 25 foot alley, 105 . 75 feet to the
place of beginning.

Part of Lot Fourteen (14) in Range "F" in the City of
Cape Girardeau, Missouri, described by metes and
bounds as follows : Begin at a point 79 % feet North
of the Northeast corner of Lot 13 in Range "F" on the
west line of Fountain Street for a beginning corner;
thence continue North along the West line of Fountain
Street 35 % feet to a corner; thence West parallel to
the south line of said Lot 14 , 180 feet to an alley;
thence South along the east line of said alley 35 %
feet; thence East parallel to the south line of said
Lot 14 , 180 feet to the point of beginning.
Tract 5
Part of Lot Fourteen (14) in Range "F" in the in the
City of Cape Girardeau, Missouri, fronting 22 feet on
Fountain Street by a depth of 180 feet to an alley,
described as follows : _.
Beginning at a point 57 % feet North:.of the Northeast
corner of Lot 13 in Range "F"... on the West line of
Fountain Street; thence North along the West line of
Fountain Street 22 feet; thence West parallel with the
south line of Lot 14 in Range "F" 180 feet to an

alley; thence South along the east line of said alley
22 feet; thence East parallel to the South line of Lot
14 , 180 feet to the point of beginning.

The South 57 . 5 feet of Lot Fourteen (14) in Range "F"
in the City of Cape Girardeau, Missouri .
Tract 7
The North 55 feet of Lot Thirteen (13) in Range "F" in
the City of Cape Girardeau, Missouri, described as
follows : Commencing on the Northeast corner of said
Lot No. 13 ; thence running South along the West side
of Fountain Street 55 feet to a corner; thence running
West parallel with Bellevue Street, 180 feet to an
alley; thence North along said alley 55 feet to the
Northern boundary line of said Lot No. 13 ; thence
running East with said line 180 feet to the place of
beginning.

The East Forty-five (45) of the North Half of Lot
Fifteen (15) in Range "F" in the City and County of
Cape Girardeau, Missouri .
Tract 9
All of that part of the North half of Lot No. Fifteen
(15) in Range "F" in the City of Cape Girardeau,
Missouri, described as follows :
Beginning Ninety (90) feet East of the Northwest
corner of said Lot No. 15 in Range "F" of said City
and run South parallel with Middle Street one-hundred
five and one half (105 %) feet to a private alley;
thence East parallel with said alley forty-five (45)
feet; thence North one hundred five and one half (105
%) feet to North Street; thence West along the South
side of North Street Forty-five (45) feet to the Place
of Beginning.

Cape Girardeau, Missouri, described as follows : Begin
at the Northwest Corner of said Lot 15 in Range "F" ,
run South along the East line of Middle Street, 116
feet, more or less, to a corner; thence run East,
parallel with the South line of North Street, a
distance of 90 feet to a corner; thence run North,
parallel with the East line of Middle Street, 116 feet
to a point on the South line of North Street; thence
West, along the South line of North Street, 90 feet to
a corner, the point of beginning.

A part of Lot Numbered Fifteen (15) in Range "F" in
the City of Cape Girardeau, Missouri, described as
follows : Beginning at a point on the East line of
Middle Street 77 feet North from the Southwest corner
of said Lot No. 15 ; and run North along the East line
of Middle Street 39 feet; thence East, parallel with
North Street, 180 feet to an alley; thence South along
the West line of said alley 39 feet, and thence west
parallel with North Street, 180 feet to the point of
beginning, being the North 39 feet of the South 116
feet of Lot Numbered 15 in Range "F" of the City of
Cape Girardeau, Missouri .
Tract 12
Part of Lot 15 in Range F, City of Cape Girardeau as
follows : Begin at a point on East line of Middle
Street, 50 feet North from Southwest corner of Lot 15,
run North along East line of Middle Street 27 feet,
thence East parallel with North Street 180 feet;
thence South along West line of alley 27 feet, thence
West parallel with North Street 180 feet to the point
of beginning, being the North 27 feet of the South 77
feet of Lot No. 15 in Range "F" in the City of Cape
Girardeau, Missouri .

Cape Girardeau, Missouri, bounded as follows :
Commence at the Southwest corner of said Lot 16 in
Range "F" and run North along the East line of Middle
Street, 161 feet for a point of beginning; thence
running East, parallel with Bellevue Street, 180 feet
to an alley; thence North along the West line of said
alley parallel with Middle Street 50 feet; thence
West, parallel with Bellevue Street to the East line
of Middle Street, 180 feet; thence South along the
East line of Middle Street, 50 feet to the point of
beginning.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an RUMD,
Residential Urban Mixed Density District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
