AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF THE
SOUTHEAST CORNER OF SPARTECH DRIVE AND
OPTIMIST DRIVE, IN THE CITY AND COUNTY OF
CAPE GIRARDEAU, MISSOURI FROM R-1 TO M-2
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from R-1, Single-family Suburban Residential
District, to M-2 , Heavy Manufacturing/Industrial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, September 7 , 2010; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from R-1, Single-family Suburban Residential District,
to M-2 , Heavy Manufacturing/Industrial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning of the southeast corner of Spartech Drive and
Optimist Drive, in the City and County of Cape Girardeau,
Missouri, from R-1, Single-family Suburban Residential District,
to M-2 , Heavy Manufacturing/Industrial District, said area
including the following described property:
THAT PART OF LAND BEING PART OF LOT NUMBER ONE (1) OF
ROBERT STURDIVANT' S SUBDIVISION OF OUT LOT 81 IN
SURVEY NUMBER 2199, TOWNSHIP 31 NORTH, RANGE 13 EAST
OF THE FIFTH PRINCIPAL MERIDIAN LOCATED IN THE CITY
AND COUNTY OF CAPE GIRARDEAU, MISSOURI, SAID PARCEL
BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS
AS FOLLOWS :
BEGINNING at a %" Iron Rod at the Northwest Corner of
Lot Numbered Four (4) of Nothdurft' s Partition in said
City of Cape Girardeau, as shown in Plat Book #4 , at

County Missouri; thence 5 . 61020' 261W. , a distance of
62 . 20 feet to a Point; thence S . 07050' 00" W. , a
distance of 478 . 00 feet to a f" Iron Rod; thence
5 . 47110100" E. , a distance of 61 . 04 feet to a %" Iron
Rod on the West Line of said Nothdurft' s Partition;
thence N. 07050100" E. , along said West Line, a
distance of 550 . 00 feet to the POINT OF BEGINNING.
Containing 0 . 590 acre, more or less in the City and
County of Cape Girardeau. As per Survey by Scott A.
Richards, Professional Land Surveyor #2359, dated July
of 2010 . Subject to existing Easements, if any.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an M-2 ,
Heavy Manufacturing/Industrial District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval . ,y►
