AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY ZONING 2952 PERRYVILLE ROAD, IN
THE CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI AS AN R-1, SINGLE-FAMILY SUBURBAN
RESIDENTIAL DISTRICT
WHEREAS, the City Planning and Zoning Commission has
recommended zoning all of the property described in Article 1 of
this ordinance as an R-1, Single-family Suburban Residential
District; and
WHEREAS, Public Notice of said zoning was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, May 3 , 2010, and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to zone the property described in
Article 1 as an R-1, Single-family Suburban Residential
District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to zone the
property located at 2952 Perryville Road, in the City and County
of Cape Girardeau, Missouri, as an R-1, Single-family Suburban
Residential District, said area including the following
described property:
That part of the Southeast Quarter of the Southwest
Quarter of Section 13 , Township 31 North, Range 13
East of the Fifth Principal Meridian in the County of
Cape Girardeau, the State of Missouri, described as
follows : Begin at the Southeast corner of the
Southeast Quarter of the Southwest Quarter of said
Section 13 , said corner being marked by a found stone;
thence with the South line said Section 13 , North 890
37 ' 00" West, 558 . 54 feet; thence leaving said South
line, North 20 13 ' 24" East, 255 . 81 feet; thence South
850 21 ' 45" East, 555 . 99 feet to a point on the
Quarter Section line of said Section 13 ; thence with

said Quarter Section Line, South 10 29 ' 14 " West,
214 . 47 feet to the Point of Beginning, and containing
3 . 00 acres more or less .
TOGETHER WITH an easement for ingress and egress
described as follows : Commence at the Southeast corner
of the Southeast Quarter of the Southwest Quarter of
said Section 13 , said corner being marked by a found
stone; thence with the South line of said Section 13 ,

said South line, North 20 13 ' 24 " West, 206 . 03 feet to

Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an R-1,
Single-Family Suburban Residential District, and that such
changes authorized hereby are reasonable and in reasonable
conformity with the existing uses and value of the immediately
surrounding properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
