AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED. AT 2552 INDEPENDENCE STREET, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI,
FROM M-2 TO NC
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from M-2, Heavy Manufacturing/Industrial
District, to NC, Neighborhood Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Monday, October 1, 2012; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 from M-2, Heavy Manufacturing/Industrial District, to
NC, Neighborhood Commercial District; and
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
ARTICLE 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning on property located at 2552 Independence Street, in
the City and County of Cape Girardeau, Missouri, from M-2, Heavy
Manufacturing/Industrial District, to NC, Neighborhood
Commercial District; said area including the following
described property:
That part of Lot Number Two (2) of Sturdivant' s
Subdivision of Outlots 58, 59, 81 and a part of 60 in
U. S. P. Survey No. 2199, Township 30 North, Range 13
East, in the City and County of Cape Girardeau, State
of Missouri, described as follows :
Commence at the Southwest Corner of said Outlot No.

- 81; -thence Northerly with the line between Outlots 81
and 82, a distance of 719 . 7 feet, to a point on the
North right of way line of Independence Street (Old
State Route "K") ; thence South 83°36' 34" East, with

said North line, 410 . 6 feet, to the point of
beginning; thence North 6023' 26" East, 105 . 42 feet to
a point; thence North 66024' 31" West, 4 . 21 feet to a
point; thence North 59033' 55" West, 105 . 1 feet to a
point; thence South 6023' 26" West, 149 . 48 feet to a
point; thence South 8303634" East, 100 feet to the
point of beginning.
Article 2. The City Council hereby finds and declares that
the property described in Article 1 hereof is at the present
time particularly suitable for the purposes and uses of an NC,
Neighborhood Commercial District, and that such changes
authorized hereby are reasonable and in reasonable conformity
with the existing uses and value of the immediately surrounding
properties .
Article 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
